The following is an itemized list of CP22 - UST FULL violations that have not been <br />addressed for DIAMOND GAS & MARKET # 10 as of January 15, 2026. <br />Open violations from July 11, 2025 inspection <br />Violation #56 - 2030013 - DO inspections completed at least every 30 days and meet all requirements (TCR <br />12). <br />OBSERVATION: The designated operator failed to check and note the correct test dates for the Secondary <br />Containment Testing on the designated operator inspection reports . The test date was recorded as 7/12/2024. The <br />correct date is 7/23/2024. <br />REGULATION GUIDANCE: During the inspection, the designated operator shall check that all required testing and <br />maintenance for the UST system have been completed and document the dates they were done . <br />CORRECTIVE ACTION: Ensure that designated operators performing inspections at this facility are including all of the <br />required information on the reports. <br />________________ <br />OBSERVATION: On February 2025 the designated operator documented N/A to the questions "alarms were <br />responded to appropriately" and the question about Containment sumps that alarmed was responded to by a qualified <br />service technician. They should have been designated Y (yes). <br /> <br />REGULATION GUIDANCE: During the inspection, the designated operator shall review the alarm history since the <br />previous inspection, check that each alarm was documented and responded to appropriately, and attach a copy of the <br />alarm history with documentation taken in response to any alarms to the inspection report. <br />CORRECTIVE ACTION: Ensure that designated operators performing inspections at this facility are including all of the <br />required information on the reports. <br /> <br />Describe actions taken or will be taken to correct violation: <br />¨ This violation will be corrected by (date): ¨ This violation was corrected <br />¨ Supporting documents included <br />Violation #72 - 2030039 - Compliance with all operating permit requirements. <br />OBSERVATION: The diesel tank was converted to bio-diesel approximately May of 2023 and a permit was not <br />obtained from the EHD. This was previously identified on the 2023 and 2024 inspection reports and has not been <br />resolved. <br />REGULATION GUIDANCE: Emergency repairs relating to UST system monitoring and release detection may be <br />performed by a properly licensed, trained, and certified contractor pursuant to the EHD's policy and a permit obtained <br />within one business day from the EHD. All other repairs must have a permit submitted to and approved by the EHD <br />prior to beginning work. <br />CORRECTIVE ACTION: Immediately obtain a permit from the EHD for the change of product for tank #3 from diesel to <br />bio-diesel . A “Failure to Obtain a Permit” penalty applies . <br /> <br />Page 1 of 2
