The facility provided a Safety <br /> Data Sheet(SDS)and profile 657300CA for the waste stream. Per the SIDS, the test specimen used for aquatic toxicity <br /> testing was Killifish, Fudulus Heteroclitus. This fish species does not meet the requirements of 22 CCR 66261.24. <br /> Aquatic toxicity testing must utilize one of three acceptable fish species: fathead minnows, rainbow trout, or golden <br /> shiners. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste as <br /> specified in Title 22 California Code of Regulations (CCR). <br /> CORRECTIVE ACTION: Immediately make a complete hazardous waste determination for Planit Safe TM 3X3 (XG) <br /> surrogate test liquid utilizing one of the three acceptable fish species: fathead minnows, rainbow trout, or golden shiners. <br /> Manage the waste according to Title 22 CCR. Submit a statement and supporting documentation with your hazardous <br /> waste determination. <br /> This is a (Class 2)Violation. <br /> 36 CA Health and Safety Code 25143.2, 25143.9 3050005 - Recyclable material is managed properly <br /> OBSERVATION: The facility is recovering a material on site and transferring it to an offsite location for recycling and is <br /> not managing the material as an excludable recyclable material. <br /> Per the facility's Spill Prevention Control and Countermeasure (SPCC) plan, secondary containment for the truck rack <br /> (dike#3)consists of a concrete pad sloped toward a central sump, leading to an underground 6,000 gallon double wall <br /> sump tank. Any captured material is immediately pumped from the underground sump tank to the oily water tank, Tank <br /> #420 which has a capacity of 20,622 gallons. <br /> The SPCC Plan also states that spills that occur in the additive dike areas (dike #2 and dike#4) and the offloading <br /> station (dike#5)also drain to the 6,000 gallon underground sump tank and are transferred to Tank#420 and that"any <br /> recovered materials will be evaluated and properly disposed of or recycled". <br /> During the inspection, Terminal Manager, Sal Rodriguez, stated that all staining in the truck rack area is addressed by <br /> routine power washing. The rinse water is recovered via the secondary containment (dike#3)and stored in Tank#420. <br /> Tank#420 was not observed labeled in accordance with HSC 25143.9. <br /> REGULATION GUIDANCE: California Health & Safety Code sections 25143.2, 25143.9, 25143.10. <br /> CORRECTIVE ACTION: Immediately begin managing this material as hazardous waste or demonstrate to the EHD that <br /> the material meets the excluded recyclable material requirements for tank labeling.
