FINDINGS FOR WILLIAMSON ACT COMPATIBILITY <br /> PA-2600014 <br /> JORDAN JONES I CALSOLAR <br /> 1. Conditions are included in the contract that mitigate or avoid those on-site and off-site impacts that <br /> would otherwise render the proposal inconsistent with the Williamson Act principles of compatibility. <br /> • This finding can be made because the proposed utility-scale solar energy facility includes <br /> measures intended to protect the long-term agricultural viability of the property and <br /> minimize impacts to surrounding agricultural operations. The project is conditioned to <br /> require submittal of a decommissioning plan and financial assurance prior to issuance of <br /> building permits to ensure that all solar panels, racking systems, fencing, electrical <br /> equipment, and associated improvements are removed at the conclusion of the project's <br /> operational life and the site restored to a condition suitable for agricultural use.The project <br /> has been designed to minimize permanent impacts to agricultural soils through the use of <br /> driven pile foundations and limited grading activities. Approximately 25.18 acres of the <br /> 39.65-acre parcel will remain available for agricultural use during operation of the facility. In <br /> addition, the project conditions will ensure the project will not interfere with surrounding <br /> agricultural operation. The project is also subject to all mitigation measures contained <br /> within the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program <br /> prepared for the project. Therefore, conditions have been incorporated into the project to <br /> mitigate or avoid impacts that could otherwise render the project inconsistent with <br /> Williamson Act compatibility principles. <br /> 2. The productive capability of the land has been considered as well as the extent to which the proposed <br /> use(s) may displace or impair agricultural operations. <br /> • This finding can be made because the subject parcel has historically been utilized for <br /> agricultural production and contains productive agricultural soils identified as Manteca fine <br /> sandy loam. The proposed solar facility would occupy approximately 14.47 acres of the <br /> 39.65-acre parcel, representing approximately 36.5 percent of the total parcel area. The <br /> remaining approximately 25.18 acres of the parcel, excluding the existing residential <br /> homesite,will remain available for agricultural use during operation of the project.Although <br /> the project would temporarily remove a portion of the property from active crop production, <br /> the proposed use is reversible in nature and does not permanently eliminate the long-term <br /> agricultural productive capability of the site. Conditions of Approval require <br /> decommissioning and restoration of the project area to agricultural use upon termination of <br /> the facility.The project has also been designed to avoid interference with irrigation delivery <br /> systems,agricultural access, drainage infrastructure, and surrounding farming operations. <br /> Therefore,the productive capability of the land has been considered, and the proposed use <br /> would not substantially impair agricultural operations on the subject parcel or surrounding <br /> properties. <br /> 3. The proposed use(s) are consistent with the intent of the Williamson Act to preserve agricultural and <br /> open-space land. <br /> • This finding can be made because Renewable Energy uses are allowable on Williamson Act <br /> contracted land pursuant to Development Title Section 9-702.060(b)(1). The proposed <br /> project does not require cancellation or non-renewal of Williamson Act Contract No.WA-72- <br /> C1-0273,which will remain in effect during operation of the facility.The majority of the parcel <br /> would remain available for agricultural use throughout operation of the project, thereby <br /> maintaining the agricultural character and function of the property. The proposed solar <br /> facility is low-intensity in nature and does not involve industrial manufacturing,commercial <br /> retail activity, or residential subdivision development inconsistent with the surrounding <br /> agricultural area.
