Right-of-Entry <br /> Former Barrera's Market: <br /> Underground Storage Tank Environmental Site Assessment <br /> The California State Water Resources Control Board (State Water Board)and the U.S. Environmental <br /> Protection Agency(U.S. EPA) have notified the City of Riverbank (hereinafter"Owner"),the owner of <br /> the property at 23653 Santa Fe Road, Escalon, San Joaquin County,California 95367,APN: 249-060- <br /> 090-000 (the "Property"), of their need for the right of access under, over and across the Property for <br /> the purpose of performing an Underground Storage Tank(UST) Environmental Site Assessment <br /> related to the Former Barrera's Market site at 23659 S.Santa Fe Road. <br /> "UST Environmental Site Assessment" shall mean all actions necessary to investigate potential <br /> releases from UST(s) at or near the Property and to ensure that any such UST releases do not pose a <br /> threat to the environment.These actions shall include, but are not limited to,groundwater sampling <br /> near the entrance to Jacob Myers Park. <br /> Owner for the Property hereby grants and extends to the State Water Board, U.S. EPA, and their <br /> agents, employees, contractors and authorized representatives,the right of access under, over, and <br /> across the Property for the purpose of performing said UST Environmental Site Assessment. <br /> Owner, and his heirs, assigns, personal representatives and/or estate understand that the State <br /> Water Board and U.S. EPA may,for whatever reason, including lack of available funds, discontinue <br /> the UST Environmental Site Assessment at anytime. <br /> Owner, and his heirs, assigns, personal representatives and/or estate understand that, consistent <br /> with subdivision (b) of section 13304 of the California Water Code,the State Water Board, U.S. EPA, <br /> or their employees shall not be held liable in a civil proceeding for trespass or for any act necessary to <br /> carry out the work described herein, and shall not be obligated to undertake additional investigation, <br /> cleanup, or other remedial work solely as a result of having conducted the work described herein. <br /> This right of entry shall terminate two years from the effective date of this Right-of-Entry or when the <br /> UST Environmental Site Assessment is completed or discontinued,whichever is sooner. <br /> Executed this c day of e C tlCt (Month), aoaa (Year) <br /> Signa ure of Owner <br /> -Ai� <br /> Printed Name <br />
