They observed it to be full." <br /> 17.SP1 and the Chandlers have denied pumping or tampering with the septic tank. It <br /> remains unclear why the septic tank contents reportedly fluctuated by several feet <br /> in mid-December 2021. Subsequent reports of the contents of the septic tank <br /> indicate it has remained stable ever since (VRC Metals, 2022c). <br /> 18.The DTSC has classified samples collected from containers that were previously <br /> disposed of into the on-Site septic system as corrosive (SP-02 and SP-03), and <br /> toxic (SP-02). Disposing these materials to the on-Site septic tank may have <br /> corroded the walls of the septic tank, allowing the contents of the septic tank to be <br /> in contact with the surrounding soils and potentially reaching groundwater. It is <br /> assumed that the liquid contents of the septic tank are designed to exit the tank <br /> and discharge to a corresponding soil leach field, as most septic systems are <br /> designed. Therefore, it is likely that chemicals discharged to the on-Site septic <br /> system have been subsequently discharged to soil, wherein they likely pose a <br /> threat to a water or waters of the State. <br /> 19.On 13 January 2022, SPI notified Central Valley Water Board staff via email <br /> that two (2) samples were collected from the septic tank on 20 December 2021 <br /> (VRC Metals, 2022a).4 The laboratory results indicated concentrations of <br /> cadmium and lead above the United States Environmental Protection Agency <br /> (USEPA) maximum contaminate level (MCL), and concentrations of copper, <br /> vanadium, and zinc above the San Francisco Bay Regional Water Quality <br /> Control Board's Tier 1 Environmental Screening Levels (ESLs). <br /> 20.On 22 February 2022, SPI submitted a Sampling Plan prepared by NES, Inc. <br /> (NES), to propose sampling soils surrounding the septic tank (NES, 2022). Central <br /> Valley Water Board staff have reviewed, commented on the report, and requested <br /> a revised version by 25 April 2022 (Central Valley Water Board, 2022a). The <br /> Sampling Plan does not propose to sample and evaluate the conditions of the <br /> septic tank, to locate and sample the leach field, or to sample groundwater. Central <br /> Valley Water Board staff have requested a revised report to include the additional <br /> investigation. On 16 April 2022, Blankinship & Associates, Inc. informed Central <br /> Valley Water Board staff via email that they are assisting SPI in resubmitting the <br /> sampling plan and requested an extension to 25 May 2022.
