CITY OF TRACY -- OFFSITE IMPROVEMENT AGREEMENT <br /> OFF-SITE DETENTION BASIN 3A <br /> PUBLIC IMPROVEMENTS <br /> Page 7 of 14 <br /> 8.2.2. Developer abandons the Work site. <br /> 8.2.3. Developer fails to perform one or more requirements of this <br /> Agreement and fails to cure any such non-performance pursuant to <br /> Section 7.3 below. <br /> 8.2.4. Developer fails to replace or repair any damage caused by <br /> Developer or its agents, representatives, contractors, <br /> subcontractors, or employees in connection with performance of <br /> the Work. <br /> 8.2.5. Developer violates any legal requirement related to the Work and <br /> fails to cure such violation pursuant to Section 7.3 below. <br /> 8.3. Cure of Default. In the event that Developer fails, within thirty (30) <br /> calendar days after receipt of written notice from the City, to either cure <br /> the default or provide adequate written assurance to the reasonable <br /> satisfaction of the City Engineer that the cure will be promptly commenced <br /> and diligently prosecuted to its completion, the City may, in its discretion, <br /> take any or all of the following actions: <br /> 8.3.1. Demand that Developer complete performance of the Work. <br /> 8.3.2. Demand that Developer's surety (if any) complete performance of <br /> the Work. <br /> 8.3.3. Resort to any judicial remedies available to the City. <br /> 9. Ownership of Work. All original documents prepared by Developer for this <br /> Agreement are the property of the City and shall be given to the City at the <br /> completion of Developer's Work, or upon demand from the City. Prior to <br /> acceptance of the Work, Developer shall submit the as-built drawings in <br /> AutoCAD format Release-14 or higher. <br /> 10. Repair of any Damage. In the event and to the extent Developer or its agents, <br /> representatives, contractors, subcontractors, or employees, in connection with <br /> performance of the Work, cause any damage to property owned by City or other <br /> property owners, then Developer shall promptly take all reasonable steps to <br /> repair or replace (as necessary) such property to remedy the damage caused <br /> thereto. <br /> 11. Inspection by City; Inspection Fees. To permit City to inspect the Work, <br /> Developer shall, at all times, provide to City reasonable and safe access to the <br /> Work site, and all portions of the Work, and to all shops wherein portions of the <br /> Work are in preparation. <br />
