The business plan was submitted late on 3/19/2025 <br />for the year of 2025. This violation has been corrected. <br /> REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br /> CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the <br />annual HMBP to CERS by January 15. <br />This is (Class 2) Violation. <br /> 4 <br />CA Health and Safety Code 25505(a)(3) 1010010 - Electronically submitted adequate response plan/procedures for <br />release/threatened release of hazmat. <br />OBSERVATION: The emergency response (ER) procedures were not complete. The local Unified Program Agency <br />(UPA) phone number was not provided on line C3. Add 209-468-3420 as the local UPA phone number on line C 3. Line <br />C6 is where the name of the nearest medical facility and phone number would go. Line C6 says "see attached" but <br />there are no other documents attached. Either add the missing document with the name and phone number of nearest <br />medical facility or the name and phone number of the nearest medical facility on line C6 and C7 on the emergency <br />response and contingency plan. <br /> REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a release <br />or threatened release of hazardous materials, including, but not limited to, the following: - immediate notification of <br />local emergency personnel and the Environmental Health Department (EHD) - procedures for the mitigation of a <br />release or threatened release to minimize any potential harm or damage to persons, property, or the environment - <br />evacuation plans and procedures, including immediate notice, for the site. <br /> CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br />This is (Class 2) Violation. <br /> 12 <br />Overall Inspection Comments: <br />FA0010863 PR0513151 SC001 04/22/2025 <br />EHD Rev. 12/06/2021 CP22 - HMBP OIRPage 2 of 3 <br />1868 E.
