OBSERVATION:The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS)annually by the due date, January 15.The business plan was submitted late on 3/19/2025 for the year of 2025. REGULATION GUIDANCE:The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is(Class 2)Violation. 12 CA Health and Safety Code 25505(a)(3) 1010010-Electronically submitted adequate response plan/procedures for release/threatened release of hazmat. OBSERVATION:The emergency response(ER)procedures were not complete. The local Unified Program Agency (UPA)phone number was not provided on line C3. Add 209-468-3420 as the local UPA phone number on line C3. Line C6 is where the name of the nearest medical facility and phone number would go. Line C6 says"see attached"but there are no other documents attached. Either add the missing document with the name and phone number of nearest medical facility or the name and phone number of the nearest medical facility on line C6 and C7 on the emergency response and contingency plan. REGULATION GUIDANCE:A business plan shall include the following emergency response procedures for a release or threatened release of hazardous materials, including, but not limited to,the following: -immediate notification of local emergency personnel and the Environmental Health Department(EHD) -procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment - evacuation plans and procedures, including immediate notice,for the site. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval.
