OBSERVATION:The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS)annually by the due date, January 15.The business plan was submitted late on 1/16/2023 for the year of 2023. The business plan was submitted late on 1/29/2024 for the year of 2024. The business plan was submitted late on 4/282025 for the year of 2025. REGULATION GUIDANCE:The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is(Class 2)Violation. 10 CA Health and Safety Code 25505(a)(1) 1010004-Complete and accurate Hazardous Materials Inventory information electronically submitted. OBSERVATION: 1240 cubic feet of argon, 1555 cubic feet of Gas N.O.S 75%argon&25%carbon dioxide,200 pounds of carbon dioxide, and 388 cubic feet of oxygen were found on site that have not been reported to CERS. Update the chemical inventory in CERS. Rubber cement and naphtha have obsolete federal hazard categories listed on the chemical fact sheet. Remove the obsolete federal hazard categories from the chemical fact sheets. REGULATION GUIDANCE:Any material that meets or exceeds the reportable quantity shall be reported in the facility's business plan. CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, add the materials to the hazardous material inventory, and submit to the EHD for approval.
