The business plan was submitted late on 2/22/2024 for the year of 2024. The business plan was submitted on time for the year of 2025. This violation has been corrected. [ REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is a (Class 2)Violation. 9 CA Health and Safety Code 25508(a)(1) 1010003 - Business Owner/Operator ID and Business Activities pages electronically submitted and are accurate OBSERVATION: The Business Owner/Operator Identification form was not complete. The business activities section has no answered for the question asking does you business generates hazardous waste. The business has used oil on site which is a hazardous waste. The third question from the top down in the business activities section need to be switched form No to Yes, my business generates hazardous wastes. REGULATION GUIDANCE: This information must be current and submitted as part of the business plan. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a (Minor)Violation. 10 CA Health and Safety Code 25505(a)(1) 1010004 - Complete and accurate Hazardous Materials Inventory information electronically submitted OBSERVATION: 120 gallons of used oil were found on site that have not been reported to CERS. Add the 120 gallons of used oil the chemical inventory in CERS. REGULATION GUIDANCE: Any material that meets or exceeds the reportable quantity shall be reported in the facility's business plan. CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, add the materials to the hazardous material inventory, and submit to the EHD for approval.
