Regional soil data <br />from non-industrial locations have similar aluminum and iron concentrations. <br />4. Field observations of native soil show it to have a reddish hue (Figure 8), indicative of <br />the presence of iron oxide. <br />5. Aluminum and iron are the only NAL exceedances and are closely associated, they <br />mutually have NAL exceedances and never apart from one another. This is indicative <br />of a common pollutant source. <br />12.3.3 Level 2 Return to Baseline Status <br />A facility with parameters at Level 2 status will return to Baseline status for that Level 2 <br />parameter if: <br />1. It submits an industrial activity BMPs demonstration which: <br />• Includes a description of the industrial pollutant sources and corresponding industrial <br />pollutants that are or may be related to the NAL exceedance(s). <br />• Includes an evaluation of all pollutant sources associated with industrial activity that <br />are or may be related to the NAL exceedance(s). <br />• Where all of a facility’s implemented BMPs, including additional BMPs identified in <br />the Level 2 ERA Action Plan, achieve compliance with the effluent limitations of the <br />General Permit and are expected to eliminate future NAL exceedance(s); and <br />• A facility shall provide a description and analysis of all implemented BMPs. <br />2. If results from four (4) subsequent consecutive QSEs sampled indicate no additional NAL <br />exceedance(s) for the Level 2 parameter(s). <br />If future NAL exceedances occur for parameter(s) at Baseline statue that were previously Level <br />2 status parameter(s), a facility’s Baseline status for that parameter will return to Level 2 status <br />on July 1 in the subsequent reporting year during which the NAL exceedance(s) occurred and <br />the facility will have to update the Level 2 ERA Technical Report as required above in General <br />Permit section XII.D.3.c. <br />12.3.4 Level 2 Return to Baseline Status Ineligibility <br />Facilities are not eligible to return to baseline status if they submit any of the following: <br />1. An industrial activity BMP demonstration which achieves General Permit compliance with <br />the effluent limitations but are not expected to eliminate future NAL exceedance(s). <br />2. A non-industrial pollutant source demonstration; or, <br />3. A natural background pollutant source demonstration. (This is the demonstration that the <br />County and its’ QISP chose for this facility.) <br />12.3.5 Level 2 ERA Implementation Extension <br />Facilities that need additional time to submit the Level 2 ERA Technical Report shall be <br />automatically granted a single time extension for up to six (6) months if requested via <br />SMARTS in accordance with General Permit section VII.D.5.a.
