This signed copy shall be retained as a record for at least three years from the date the waste was accepted by the initial transporter. The hazardous waste generator must submit an exception report to the California Department of Toxic Substances Control (DTSC)within 45 days if the destination facility signed manifest copy is not received from the transporter or designated facility. CORRECTIVE ACTION: The violation was corrected during the inspection by Theresa Geijer obtaining copies of the final signed manifests. No further action is required to correct this violation.. This is(Class 2)Violation. 51 CA Health and Safety Code 25143.2, 25173.9 3150004- Recyclable material is managed properly. OBSERVATION: Per the facility's Spill Prevention Control and Countermeasure (SPCC)plan,the loading rack area is equipped with a quick drainage system that drains into the lift station which then pumps to Tank 13. During the inspection, facility personnel stated that recovered material is stored in Tank 13 until a volume of 6,200 gallons is reached, at which time it is transported to the Carson City Shell facility and reintroduced into the crude stream. During the inspection, Tank 13, containing water with petroleum products,was observed with the label "Excludable Recyclable Material". Tank 13 was not observed labeled, marked, and placarded in accordance with all of the department's hazardous waste labeling requirements applicable to generators.The tank label was missing the indication of the hazards of the contents, and the accumulation start date. Some parts are included here: HSC 25143.9. Recyclable material exclusions. A recyclable material shall not be excluded from classification as a waste pursuant to subdivision (b)or(d)of Section 25143.2, unless all of the following requirements are met: (a)The material is held in a container,tank, containment building, or waste pile that is labeled, marked, and placarded in accordance with the department's hazardous waste labeling, marking, and placarding requirements applicable to generators, except that the container,tank, or containment building shall be labeled or marked clearly with the words "Excluded Recyclable Material," instead of the words"Hazardous Waste,"and manifest document numbers are not applicable.
