The hazardous waste generator must submit an exception report to the <br /> California Department of Toxic Substances Control (DTSC)within 45 days if the destination facility signed manifest <br /> copy is not received from the transporter or designated facility. <br /> CORRECTIVE ACTION: The violation was corrected during the inspection by Theresa Geijer obtaining copies of the <br /> final signed manifests. No further action is required to correct this violation.. <br /> This is(Class 2)Violation. <br /> 51 CA Health and Safety Code 25143.2, 25173.9 3150004- Recyclable material is managed properly. <br /> OBSERVATION: Per the facility's Spill Prevention Control and Countermeasure (SPCC)plan,the loading rack area is <br /> equipped with a quick drainage system that drains into the lift station which then pumps to Tank 13. During the <br /> inspection, facility personnel stated that recovered material is stored in Tank 13 until a volume of 6,200 gallons is <br /> reached, at which time it is transported to the Carson City Shell facility and reintroduced into the crude stream. <br /> During the inspection, Tank 13, containing water with petroleum products,was observed with the label "Excludable <br /> Recyclable Material". <br /> Tank 13 was not observed labeled, marked, and placarded in accordance with all of the department's hazardous waste <br /> labeling requirements applicable to generators.The tank label was missing the indication of the hazards of the <br /> contents, and the accumulation start date. <br /> REGULATION GUIDELINES: See California Health &Safety Code section 24143.2 and 25143.9 for the complete <br /> statute. See Title 22 California Code of Regulations for hazardous waste regulations. Some parts are included here: <br /> HSC 25143.9. Recyclable material exclusions.
