The tank label was missing
the indication of the hazards of the content, and the accumulation start date.
Corrective action response as follows:
Tank 13 is labeled in accordance with Section 25143.9 (of CA H&S code) with the Excluded Recyclable
Material (ERM) label. In accordance with 22CCR 66262.17(a)(5)(B)2, it is labeled with an indication of the
hazards of the content; it is labeled with a Chemical Hazard Label consistent with NFPA code 704 (picture
attached).
The accumulation start date label referred to in 66262.17(a)(5)(B)3 is not applicable as it is not a hazardous
waste. However, in accordance with the requirements in 40CFR261.1, the accumulation period is being
documented as follows. Daily tank level gauge readings document the volume in the tank, and pump out
records in the form of BOLs document removal of ERM from the tank. In addition, going forward, a log will
be used to document the volume in the tank on January 1 each year, the date of each pump out, the volume
in the tank prior to pump out and the volume removed. This will document that the amount of material
transferred is at least 75% of the volume accumulated at the beginning of the period. Instead of a label on
the tank the regulation allows for maintaining a log for this purpose.
W RAW" pggp?I9#2
