Upon its acceptance,this proposal will became a binding contract enforceable between the parties hereto. <br /> 1. Scope of Work. <br /> PRO SE SERVICES to provide equipment, labor, expertise and insurances necessary,to torch cut and remove <br /> press and associated piping located at the Lathrop Water Treatment Facility for a lump sum of$9,750.00 USQ. <br /> Price includes the disposal and transport of filter press. Price includes prevailing wages. Carport, compressor, <br /> and fiberglass tank to remain. <br /> [I. Llmitatlons and Terms. <br /> A) Pro SE Services,Inc.will not be responsible for any environmental conditions,hazardous waste,materials,or <br /> other conditions affecting the above referenced work. <br /> III. Terms of Payment. <br /> A) Pro SE Services,Inc.will perform the work set Forth in the Scope of Work above for$9,750.00.Payment will <br /> he due upon receipt. <br /> IV. Other Matters. <br /> A) To the extent that Pro SE Services,Inc.generates any revenue from the disposal of said materials, said revenue <br /> belongs to Pro SE Services,Inc. exclusively. <br /> B) Indemnification. <br /> Customer will indemnify and hold harmless Pro SE Services, Inc. from any casts or expenses, including reasonable <br /> attorneys' fees and expert casts incurred in conjunction with any non-disclosure, misrepresentation or unforeseen <br /> circumstances that gives rise to extra cast or expense arising out of the Scope of Work referred above. In the event that <br /> Pro SE Services, Inc. discovers any hazardous customer shall be responsible for all casts relating to the handling, <br />
