TECHNICAL REPORTING ORDER R5-2017-0839 -3- <br /> SAN JOAQUIN COGEN, LLC, ETAL I <br /> HEOROT POWER HOLDINGS <br /> 17200 MURPHY PARKWAY, LATHROP <br /> SAN JOAQUIN COUNTY <br /> knowingly falsifies any information provided in those technical or monitoring program <br /> reports, is guilty of a misdemeanor, may be civilly liable in accordance with subdivision <br /> (d), and is subject to criminal penalties pursuant to subdivision (e). <br /> (d)(1) Civil liability may be administratively imposed by a regional board ... for a <br /> violation of subdivision (c) in an amount which shall not exceed five thousand dollars <br /> ($5,000)for each day in which the violation occurs. <br /> 9. Failure to submit the required report to the Central Valley Water Board according to the <br /> schedule detailed herein may result in enforcement action(s) being taken against you, <br /> which may include the imposition of administrative civil liability pursuant to CWC section <br /> 13268. Because regulated agricultural chemicals are a hazardous waste, administrative <br /> civil liability of up to $5,000 per violation per day may be imposed by the Central Valley <br /> Water Board for non-compliance with the directives contained herein. <br /> REQUIRED ACTIONS <br /> IT IS HEREBY ORDERED that, pursuant to California Water Code section 13267, I <br /> Dischargers must submit the following technical reports: ! <br /> 1. A Site Investigation Work Plan to define the extent and characteristics of the two landfill <br /> cells that extend onto Site property from 500 E. Louise Ave in Lathrop. The Work Plan <br /> must also include evaluation for presence of potential pollution from the unpermitted <br /> landfills in groundwater and soil beneath and down-gradient of the Site. The Investigation <br /> Work Plan must include, at a minimum, the following: <br /> I <br /> a) Collection of soil samples to assess the locations of landfilled waste cells i <br /> b) Define vertical and lateral extent of the waste cells i <br /> I <br /> c) Characterize the waste stream <br /> d) Evaluate soil and groundwater beneath the waste cells for constituents of concern <br /> 2. A Site Historical Activity Report that includes how the Site was utilized by LOF/PNA , , <br /> historical waste handling and disposal operations, landfill investigations, and/or <br /> remediation activities disclosed at the time of property sale or otherwise transmitted. i <br /> The Site Historical Activity Reports and Investigation Work Plans for each of the Sites <br /> listed in this Order must be submitted no later than 15 January 2018.
