("Investigator") and Manuel DaSilva (the " roperty Owner"). RECITALS A. The Property Owner owns certain real property located at 15668 Steinegul Road Escalon, California The "Property"). B. Investigator is concluding a subsurface investigation pursuant to the terms of an agreement entered into with Former Raymond Greer Construction. C. Investigator wishes to complete case closure activities regarding an environmental investigation as directed by Central Valley Regional Water Quality Control Board and includes the groundwater monitoring well located on the Property to finalize closure status. NOW THEREFORE, in consideration of the mutual convenants contained herein, it is hereby agreed as follows: 1. Grant of License. Subject to the terms and conditions of this Agreement, the Property Owner hereby grants Investigator a license to enter the Property for the limited purpose of observing the site and properly abandoning the existing groundwater monitoring well. Investigator may be accompanied in these activities by authorized representative of Central Valley Regional Water Quality Control Board. 2. Limitations on Use. a.) Prior to each entry onto the Property, Investigator shall provide forty-eight (48) hours notice to the Property Owner, arrange for access, and, if requested by the Property Owner, allow oversight of all on-site activities. b.) Investigator shall ensure that none of its activities on the Property unreasonably interferes with or delays any other activities which are being undertaken on the Property. 3. Term. The term of this Agreement shall commence on the date of execution of this Agreement and shall continue thereafter until Investigator has completed properly abandoning the existing groundwater monitoring wells or until July 31, 2021. 4. Agreement Not Admission. By entering into this Agreement, neither the Property Owner or Investigator is admitting any responsibility for any contamination at the Property. This Agreement shall not be construed or interpreted as an admission or concession of liability on the part of either the Property Owner or Investigator.
