March 20,2018 <br /> ® �I Page 1 of 2 <br /> SITE ACCESS AGREEMENT <br /> This Agreement is entered into as of the 23- day of Mac-v- 2018, between ATC Group <br /> Services LLC. ("Investigator") and Steve Sawyer (the "Property Owner"). <br /> RECITALS <br /> A. The Property Owner owns certain real property located at 15400 Steinegal Road <br /> Escalon, California and further identified by the San Joaquin County Assessor as <br /> Parcel No. 229-120-22 (The "Property"). <br /> B. Investigator is conducting a subsurface investigation pursuant to the terms of an <br /> agreement entered into with Former Raymond Greer Construction. <br /> C. Investigator desires to enter onto the property, for the purpose of performing its <br /> environmental investigation, including but not limited to, the following (collectively <br /> the "Authorized Activities"). <br /> 1. Access to mark and clear for all subsurface utilities; <br /> 2. Installation of two (2) groundwater monitoring wells (the "Wells") as <br /> shown on the Well Installation Plan, attached hereto and incorporated <br /> herein by reference as Exhibit "A"; <br /> 3. Quarterly monitoring, sampling, and maintenance of the wells; and <br /> 4. Eventual proper well abandonment in accordance with state and/or <br /> local protocols. <br /> NOW THEREFORE, in consideration of the mutual covenants contained herein, it is hereby <br /> agreed as follows: <br /> 1. Grant of License. Subject to the terms and conditions of this Agreement, the <br /> Property Owner hereby grants Investigator a license to enter onto the Property <br /> for the limited purpose of conducting the Authorized Activities. Investigator <br /> may be accompanied in these activities by authorized representative of San <br /> Joaquin County Environmental Health Department or Regional Water Quality <br /> Control Board. <br /> 2. Limitations on Use. <br /> a.) Prior to each entry onto the Property, Investigator shall provide forty-eight (48) <br /> hours notice to the Property Owner, arrange for access, and, if requested by the <br /> Property Owner, allow oversight of all on-site activities. <br /> b.) Investigator shall ensure that none of its activities on the Property unreasonably <br /> interferes with or delays any other activities which are being undertaken on the <br /> Property. <br /> ATC Project Number: Z054000007 <br />
