Hickox <br />Secretary for <br />Environmental <br />Protection <br />The NONA states that none of the facility’s storm water discharges directly or indirectly to waters of the <br />United States because all storm water is discharged to an offsite evaporation/percolation pond. This <br />statement is not entirely accurate. Our inspection of the facility on 21 November 2001 revealed that the <br />evaporation/percolation pond that you use for storm water disposal is in the flood plain. Therefore, you <br />discharge storm water to surface water, albeit indirectly. In addition, your storm water data show the <br />presence of Total Kjeldahl Nitrogen (TKN), nitrate as N, and biochemical oxygen demand (BOD) at <br />33.4 2, and 28 mg/1, respectively. TKN, nitrate as N, and BOD are storm water pollutants. Furthermore, <br />our inspection found accumulation of petroleum products in a parking lot drain sump at the southern <br />section of the facility. Petroleum products are also storm water pollutants.
