The business plan wad submitted late on 2/14/2025 for the facility and plans sections for the year of of 2025. The inventory section has not been submitted for the year of 2025. Immediately make a new submittal for the inventory section. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is a Repeat (Class 2) Violation. 9 CA Health and Safety Code 25508(a)(1) 1010003 - Business Owner/Operator ID and Business Activities pages electronically submitted and are accurate OBSERVATION: The Business Owner/Operator Identification form was not submitted or complete. The business activities sections is marked No for the business generating waste. The business generates cutting fluid waste and used motor oil waste. Please change the third question in the business activities section from No to Yes for generating hazardous waste. REGULATION GUIDANCE: This information must be current and submitted as part of the business plan. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a Repeat (Class 2) Violation. 10 CA Health and Safety Code 25505(a)(1) 1010004 - Complete and accurate Hazardous Materials Inventory information electronically submitted OBSERVATION: 55 gallons of used motor oil and 55 gallons of used cutting fluid were found on site that have not been reported to CERS. Add the used cutting fluid and the used motor oil to the chemical inventory in CERS. REGULATION GUIDANCE: Any material that meets or exceeds the reportable quantity shall be reported in the facility's business plan. CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, add the materials to the hazardous material inventory, and submit to the EHD for approval.
