The business plan was submitted late on 1/26/2023 for the year 2023. The business plan was submitted on time for the years 2024 and 2025. This violation has been corrected. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is a (Class 2) Violation. 10 CA Health and Safety Code 25505(a)(1) 1010004 - Complete and accurate Hazardous Materials Inventory information electronically submitted OBSERVATION: The Hazardous Materials Inventory forms for Various Resins, Organic Peroxides, and Acetone were not complete. The max daily amounts for Various Resins, Organic Peroxides, and Acetones were not correct. The max daily amount for Various Resins is listed at at 82,604 pounds but there is 132,405 pounds on site. The max daily amount for Organic Peroxide is 1,705 but there is 11,500 pounds on site. The max daily amount for Acetone is listed at 3,600 pounds but there is 11,520 pounds on site. Update the max daily amounts. 8,120 pound of Everhold N681 Mold Release and 3,080 pounds of Everhold N900 Vacum infusion adhesive were found on site and have not been report on the chemical inventory. Add Everhold N681 and Everhold N900 to the chemical inventory in CERS. REGULATION GUIDANCE :The Hazardous materials inventory information must be current and submitted as part of the business plan. CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval.
