PUBLIC UTILITIES COMMISSION <br /> City and County of San Francisco <br /> RESOLUTION NO. 07-0187 <br /> WHEREAS, The City and County of San Francisco Public Utilities Commission <br /> (SFPUC) owns certain real property under it's jurisdiction in San Joaquin County; and <br /> WHEREAS, Teichert Aggregates, a California Corporation, has requested a Revocable <br /> Permit for approximately 120 sq. ft. of space also known as the permit area from the City for a <br /> conveyor for transporting quarry materials ; and <br /> WHEREAS, space is available over the right-of-way located at Vernalis and the SFPUC <br /> desires to enter into a Permit for such use; and <br /> WHEREAS, San Joaquin County is considered the Lead Agency under the California <br /> Environmental Quality Act ("CEQA") and prepared an environmental impact report ("EIR") for <br /> the entirety of the proposed project; and <br /> WHEREAS, the SFPUC is considered a responsible agency under CEQA because it is <br /> approving the Permit, which is necessary to implement the larger project; and <br /> WHEREAS, the EIR prepared by San Joaquin County is contained in SFPUC files and is <br /> available for public and this Commission's review; and <br /> WHEREAS, The SFPUC and Teichert Aggregates, a California Corporation, have agreed <br /> to enter into a month-to-month permit for conveyor air rights located in Vernalis for $2,880 per <br /> year; now, therefore, be it <br /> RESOLVED, That the SFPUC has (1) considered the applicable information in the Final <br /> EIR contained in SFPUC files for this Permit, (2) adopts and incorporates by reference as though <br /> fully set forth in this Resolution the CEQA findings adopted by the San Joaquin Planning <br /> Commission on December 3, 1992, as set forth in the San Joaquin County Community <br /> Development Department Staff Report, including a mitigation monitoring and reporting program <br /> and a statement of overriding considerations, as contained in the SFPUC file for this Permit, (3) <br /> finds that no additional CEQA review is required because there are no changes in the project or <br /> the circumstances surrounding the Permit that would cause new or more severe environmental <br /> impacts; and be it <br /> FURTHER RESOLVED That the SFPUC hereby approves the terms and conditions of <br /> the Permit of air rights ,for a conveyor over the SFPUC's right-of-way and authorizes execution <br /> of that certain Permit of approximately 120 square feet to Teichert Aggregates, a California <br /> Corporation, for the purpose of installing a conveyor, commencing November 1, 2007 on a <br /> month-to-month basis, provided that the Teichert Aggregates, a California Corporation shall pay <br /> rental rate of$2,880 per year; and be it <br /> FURTHER RESOLVED, That upon approval by the SFPUC, the Director of Property is <br /> hereby authorized and directed to execute such Permit; and be it <br />
