AGREEMENT <br /> THIS IS AN AGREEMENT between the City of Tracy, a Municipal Corporation, <br /> herein after-called the "Owner," and <br /> herein after-called the "Contractor." Owner and Contractor for the consideration hereinafter <br /> named agree as follows: <br /> SCOPE OF WORK: <br /> Contractor shall furnish all materials, equipment, and labor and perform all of the <br /> Work for the construction of the NORTHEAST INDUSTRIAL PHASE II WATER AND SEWER <br /> PROJECT, CIP Nos. 7468, 7589, 7590 in accordance with the Contract Documents. <br /> CONTRACT PRICE: <br /> As full compensation for furnishing all materials, equipment, labor and for doing the <br /> Work contemplated and embraced in this Agreement, for all loss or damage arising out of the <br /> nature of the Work aforesaid, or from the actions of the elements, or from any difficulties or <br /> obstructions which may arise or be encountered in the prosecution of the Work until its <br /> acceptance by Owner, for all risks connected with the Work, for all expenses incurred by or in <br /> every kind connected with the Work, for all expenses incurred by or in consequence of the <br /> suspension or discontinuance of Work, and for well and faithfully completing the Work, and the <br /> whole thereof, in the manner and according to the Contract Drawings, Owner shall pay the <br /> amount specified by Contractor on the Bid Form supplied by Owner. <br /> CONTRACT DOCUMENTS: <br /> The further terms, conditions, and covenants of the Agreement are set forth in the <br /> Contract Documents, each of which is by this reference made a part hereof. <br /> Formation of a contract between the parities requires accomplishment of the following: (1) <br /> Execution of this Agreement by Contractor; (2) Submission by Contractor and approval of City <br /> of the required bonds and insurance; (3) Execution of this Agreement by City. No Contract <br /> shall arise until these three elements have been accomplished. <br /> TIME OF COMPLETION: <br /> The work called herein shall be commenced only after receipt of the Notice to Proceed. <br /> The Notice to Proceed will be issued by City after award of which shall specify the first day <br /> charged to the Contract and the Work shall be fully completed within the time limit set forth in <br /> Information for Bidders. <br /> CONTRACTOR'S LICENSE: <br /> In accordance with California Business and Professions Code Section 7030, the <br /> Contractor is required by law to be licensed and regulated by the Contractors' State License <br /> Board, which has jurisdiction to investigate complaints against contractors if a complaint is filed <br /> within three years of the date of the alleged violation. Any questions concerning the Contractor <br /> may be referred to the Registrar, Contractors' State License Board, P.O.
