EXHIBIT "B" <br /> EASEMENT AND MAINTENANCE AGREEMENT <br /> Preamble and Recitals <br /> This Agreement is entered into on ,by and between,hereafter referred <br /> to as APN#019-020-50"Grantors"and APN#dl9- 0-52 hereafter referred to as"Grantees". <br /> A. Grantors the owners of certain real property situated in the County of San Joaquin,California <br /> consisting of PAR"A"0.221 acre parcel being depicted as APN#019-020.-50,San Joaquin County Records. <br /> B. Grantors and Grantee desire and intend that Grantees and their successors hereby receive an <br /> easement for the purposes set forth below. <br /> C. Grantors and Grantees desire and intend that the easement right granted hereby shall run with <br /> the land and that the agreements and respective rights and duties of the parties set forth herein shall bind <br /> and inure to the benefit of Grantor,and Grantees and their respective successors and assigns. <br /> NOW THEREFORE,the parties agree as follows: <br /> Incorporation <br /> 1. The parties incorporate by this reference the foregoing preamble and recitals as if full set forth <br /> herein verbatim. <br /> Grant of Easement <br /> (Location) <br /> 2. Grantors hereby grants to Grantees and their successors and assigns,an easement for sewer pipe <br /> 4 feet wide located parallel and adjacent to the 140 feet south edge of the parcel being depicted as APN# <br /> 019-020-50,San Joaquin County Records. <br /> Description of Easement <br /> 3. The easement granted in this Agreement is an easement for sewer pipe purposes only. For <br /> purposed of this Agreement,"sewer pipe purposes"means use for the installation and maintenance of sewer <br /> pipe only. <br /> Nonexclusive Easement <br /> 4. The easement granted in this Agreement is nonexclusive. Grantors retains the right to resale <br /> any use of the Easement,including the right to grant concurrent easements in the Easement to third parties, <br /> that does not interfere unreasonably with Grantee's free use of the easement for purposed in this agreement. <br /> Maintenance of Easement <br /> 5. Grantees shall leave easement in good repair consistent with the level of improvement as of the <br /> date of installation of sewer pipe. Replace all concrete,utility,sprinkler lines,backfill and compact to <br /> condition prior to the start of instillation or maintenance.Grantees shall be responsible for the costs and <br /> expenses of any damages done. <br /> Attorney's Fees <br /> 6. If any legal action or proceeding arising out of or relating to this Agreement is brought by either <br /> party to this Agreement,the prevailing party shall be entitled to receive from the other party,in addition to <br /> any other relief that may be granted,the reasonable attorneys'fees,cost,and expenses incurred in the action <br /> or proceeding by the prevailing party. <br />
