Permittee shall make written notice to, and coordinate with, California Highway Patrol <br /> seven (7) days before encroachment activities are scheduled. Letter copies shall be provided to <br /> the State's representative to evidence contact. <br /> 2. If rain, fog, or other elements should significantly affect safety for even participants or <br /> vehicular traffic, Caltrans may take whatever action is necessary to protect the public. Also, if <br /> some unforeseen reason the traffic demands for the State facility significantly exceeds the <br /> anticipated demand, it maybe necessary to terminate the event. <br /> 3. In accordance with Subdivision (a) of Streets and Highway Code Section 682.5, the <br /> Department of Transportation shall not be responsible for the conduct of operation of the <br /> permitted activity, and the applicant agree to indemnify and hold harmless the State and the city <br /> or county against any and all.claims arising out for which the permit is issued. <br /> 4. Displays such as barricades, temporary facilities, detour signs, and all other equipment <br /> used in the Traffic Control shall be removed at the end of the cleanups which shall be the <br /> responsibility of the Permittee. <br /> 5. Any damage to State property caused by any authorized activity by this permit shall be <br /> immediately repaired and brought to its original condition or better at no cost to State to the <br /> satisfaction of the State Representative. <br /> Permittee shall place public notification signs at locations designated on the approved signing <br /> plan a minimum of seven (7) calendar days before the activity begins. Signs shall be constructed <br /> and installed to Caltrans specifications and standards. <br /> All work shall be conducted in such a manner that the dirt, materials and equipment will not <br /> cause any inconvenience to the highway traffic or to traffic entering the highway from any public <br /> or private approach. <br /> No dirt or materials are to be dragged or scraped across the highway pavement. No dirt shall be <br /> placed or allowed to remain at a location where it can be tracked onto the highway traveled way <br /> or any public or private approach by the Permittee's equipment or by traffic entering or leaving <br /> the highway traveled way. Any dirt or mud so tracked onto the highway pavement or public or <br /> private approach shall be immediately removed by the Permittee. <br /> Permittee shall comply with all local and State requirements and obtain prior approval from all <br /> affected agencies. <br /> Permittee shall furnish,place, and maintain required signs, safety equipment,and traffic control <br /> and warning devices in accordance with the Manual of Traffic Controls published by the <br /> Department of Transportation. <br /> Signs shall be place in such a manner as to NOT to constitute a hazard to the traveling public. <br /> Signs are to be removed immediately after the cleanups. <br /> 3 <br />
