•ENCROACRMEWPERM[T@ENERALPROVISIONS13—i.1.Thispermitisissuedunderandsuljecttoalllasandordinancesofagencies-gevemingtheencroashmenthereinpealttejee.-efollowingreferences:STREETSANDHtGIIWAYSCODE1.DivisionI,Chapter32.Division2,Chapter2,Sectiort9423.Division2,Chapter4,ecfion11264.Division2,Chapter5.5andChapter6SANJOAQDINQUNTYORDINANcESNEJIvIEERFD:324,441,-648,662,672,695,700,860,892.3339,and3675..2.ItisunderstoodandagreedbythePennitteethattheperformanceofanyworkunderthispem2ItShallconstituteanacceptanceofalltheprovisionscontainedhereinandfailureon thePermittee’sparttocomplywithanyprovisionwillbecauseforrevocationofthispeimitExceptasotherwiseprQvidedforpublicagenciesandfranchiseholders,thispermitisrevocableonfivedaysnotice.3.Allworkshallbe donesubjecttothesupervisionofandthesatisfactionofthegrantor.ThePermitteeshallatalltimesduringtheprogress.oftheworkkeeptheCountyBighwayinasneatandcleanconditionasispossibleanduponcompletionoftheworkauthorizedherein,shallleavetheCountyTflghwayinathoroughlyneat,cleanandusablecondition.4.ThePermitte&alsoagreesbytheacceptanceofthispermittoproperlymaintainanyencroachmentstructure-placedbythePerrnitteeonanypartoftheCountyBInjiwayandtoimmediatelyrepairanydamagetoanyportionofthehighway,whichoccursasaresultofthemaintenanceofthesaidencroachmentstructure,untilsuchlimeasthePermitteemayberelievedoftheresponsibilityforsuchmaintenancebytheCountyofSanloaquin.S.ThePermitteealsoagreesbytheacceptanceofthispermittomake,.atitsownexpense,suchrepairsasmaybedeemednecessarybytheCountyDepartmentofPublicWorks.6.ItisfurtheragreedbythePeimitteethatwheneverconstruction,reconstructionasmaintenanceworkuponthehighwayisnecessary,theinstallationprovidedforhereinshall,uponrequestoftheCountyDepartmentofPublicWorks,beimmediatelymovedorremovedbyandatthesole expenseofthePermittee.7.NomaterialusedforfillorbackEllintheconstructionoftheencroachmentshallbeborrowedortakenfrom‘withintheCountyrightofway.8.AllworkshallbeplannedandcarriedoutwithaslittleincovenienceaspossibleInthetravelingpublic.Nomaterialshallbestackedwithineightfret(8’)oftheedgeofthepavementortraveledwayunlessotherwiseprovidedherein.Adequateprovisionshallbemadefortheprotectionofthetravelingpublic.TrafficcontrolstandardshalIbeutilizedincludingbarricades;approvedsignsandlights;and.flagnien,asrequiredbytheparticularworkinprogress.-9.ThePermittee,bytheacceptanceofthispermit,shallassumefullresponsibilityforallliabilityforpersonalinjuryordamagetopropertywhichmayariseoutoftheworkhereinpermitted.orwhichmayariseoutofthefailureofthepartofthePerroitteetoproperlypeifountheworkprovidedunderthispermit.IntheeventanyclaimofsuchliabilityismadeagainsttheCountyofSanToaquinoranìdepartment,officialoremployeethereof,thePermitteeshafldefend,inderñnify,andhold eachofthemharmlessforsuchclairw10.Allbackfillmaterialistobemoistenedasnecessaryandthoroughlycompactedwithmechanicalmeans.IfreqñiredbytheCountyDirectorofPublicWorks,suchbaclllshallconsistofgravel,orcrushedrock.ThePeimitteeshallmaintainthesurfaceoverstructuresplacedhereunderasmaybenecessarytoinsurethereturnoftheroadwaytoacompletelystableconditionanduntilrelievedofsuchresponsibilitybytheCountyDepartmentofPublicWorks.Whereveragravel,crushedrockorasphaltsurfaceisremovedordamagedinthecourseofworkrelatedtothepermittedencroachment,suchmaterialshalleitherbeseparatelystoredandreplacedintheroadwayasnearlyaspossibleinitsoriginalstateorshallbereplacedinhind,andtheroadwayshallbeleftinatleastasgoodaconditionasitwasbeforethecommencementofoperationsofplacingtheencroachmentstructure.11.Wheneveritbecomesnecessarytosecurepermissionfromabuttingpropertyownersfortheproposedwork,suchauthoritymustbesecuredbythePermitteepriortostartingwork.12.Thecurrentandfuturesafetyandconvenienceofthetravelingpublicshallbegivenevery’considerationinthelocationandmethodsofconstiictionutilized.13.ThePemiitteeisresponsibleforthepreservationofsurveymonumentslocatedwithintheareaofworkhereinpermitted.Priortothestartofconstruction,surveymonumentsthatpotentiallymaybedisturbedshallbelocatedandreferencedbyaLicensedLandSuirveyo;andaCornerRecordfiledwiththeCountySurveyor.AnySurveyMonumentsdisturbedduringthecourseofconstructionshallbereestablishedbyaLicensedLandSurveyorandanotherCornerRecordifiedwiththeCountySurveyor.(LandSurveyors’ActSection8771)14.Priortoanyexcavation,thePermitteeshallnotifyUSANorth.(UndergroundServiceAlertofNorthernCaliforniaandNevada)at811or800-227-2600forty-eight(48)hoursinadvance.m\?mMrrsconThR\gueiIpr,i,io,,,\G,ner1P-ons2On.do--
