ENCROACHMENT PERMIT GENERAL PROVISIONS 13-11. This peιmit is issued under and subject to all laws and ordinances of agencies governing the enc1Όachn1ent herein peπηitted. Division 2, Chapte1· 4, Section 11264.Division 2, Chapte1· 5.5 and Chapte1· 6SAN JOAQUIN COUNTY ORDINANCES NUMBERED: 324,441,648,662, 672, 695, 700, 860, 892, 3359, and 3675. 2.It is ιιnderstood and agreed by the Peι-mittee that the perfoπηance of any work undeι· this permit sl1all constitute an acceptance of all theprovisions contained herein and failure on the Peι·mittee's part to comply with any provision will be cause fοι-ι-evocation of ti1is penηit.Except as otherwise provided fo 1· pιιblic agencies and franchise holdeι-s, this peπnit is revocable οη five days notice.3.ΑΙΙ work shall be done subject to the supervision of and the satisfaction oftl1e grantoι·. The Pennittee shall at all tiιηes duΓing the pωgressofthe woΓk keep the County Highway in as neat and clean condition as is possible and upon completion oftl1e woΓlc aιιthoι·ized herein,shall leave the County Highway in a thoroughly neat, clean and usable condition.4.The Peπηittee also agrees by the acceptance ofthis permit to p1Όpeι-ly maintain any enc1Όachn1ent st1-ucture placed by tl1e Peπηittee οη anypart ofthe County Highway and to im111ediately repair any damage to any portion ofthe highway, whicl1 occuΓs as a ι-esult of themaintenance of the said encroach111ent structure, until sucl1 time as the Permittee may be relieved oftl1e responsibility fοΓ such maintenanceby the County of San Joaquin.5.The Per111ittee also agrees by the acceptance ofthis pernιit to 111ake, at its own expense, such repairs as 111ay be dee111ed necessaιγ by theCounty Department of Public Works.6.It is further agreed by the Permittee that whenever construction, reconstruction or maintenance woΓk upon the highway is necessary, theinstallation provided fοι· heΓein shall, upon request of the County Depart1nent of Public Worlcs, be i111mediately moved or removed by andat the sole expense of the Peπηittee.7.Νο material used for fill οι-backfill ίη the constΓUction of the encωachn1ent shall be borrowed or talcen from within the County right ofway.8.ΑΙΙ work shall be plaιmed and caπied out with as little inconvenience as possible to the traveling public. Νο material shall be stackedwithin eight feet (8') of the edge ofthe pavement or traveled way unless otherwise provided herein. Adequate provision shall be made fo rthe protection of the traveling public. Traffιc control standaι·ds shall be υtilized including baπicades; approved signs and lights; andflagmen, as requiΓed by the paιiicular work in progι·ess.9.The Permittee, by the acceptance of this peπnit, shall assume full responsibility for all liability for peι·sonal injury or damage to propertywhich may aι-ise out of the woι-lc herein permitted οι-which may arise out ofthe fa ilure ofthe part ofthe Peι-mittee to properly perform thework provided undeι-this peιmit. Ιη the event any claim of sucl1 liability is 1ηade against the County of San Joaquin or any department,official or employee theι-eof, the Permittee shall defend, indemnify, and hold each of them haι·mless for such claiιη.1 Ο. All baclcfιll material is to be moistened as necessaιγ and thorougl1ly coιηpacted with mechanical ιηeans. If required by the County Directoι· of Public W oι-ks, such backfill shalJ consist of gravel οι-αusl1ed rock. The Peπnittee shall maintain the surface ove1· structures placed hereunder as 1ηay be necessary to insure the retum of the roadway to a completely stable condition and until 1·elieved ofsuch responsibility by the Connty Depa1iment of Public Works. Wherever a gravel, cιυshed rock or asphalt surface is Γemoved or damaged in the conι-se of work related to tl1e peπηitted encroachment, snch material shall either be sepaι·ately stoΓed and replaced in the roadway as nearly as possible ίη its original state ΟΓ sl1al1 be replaced in kind, and the ωadway shall be left in at least as good a condition as it was before the commencement of operations of placing the encroachment stn1ctuΓe. 11.Wheneνet" it becomes necessaιγ to secure permission fi-om abutting pωperty owners for the proposed woι-k, snch authority must be securedby the Peπnittee pι·iοι-to staιiing worlc.12.The cuΙTent and futuι·e safety and convenience of the tJ·aveling public shall be given every considet"ation in tl1e location and methods ofconstruction utilized.13.The Permittee is responsible for tl1e pΓeservation of sω-vey monuments located within the aι·ea of work heΓein permitted. Prior to the startof construction, survey monυments that potentially may be distυ1·bed shall be located and referenced by a Licensed Land Sω-veyoι·, and aCorner Record filed witlι the Coι1nty Sυrveyoι-.
