ENCROACHMENT PERMIT GENERAL PROVISIONS <br />13-1 <br />1. This permit is issιιed ιιnder and subject to aII laws and ordinances of agencies governing the encroachrnent herein permitted. See the <br />foilowing references: <br />STREETS AND IΠGHWAYS CODE <br />1. Division 1, ChapteJ" 3 <br />2. Division 2, Cl1apte1· 2, Section 942 <br />3. Division 2, Chapter 4, Section 1126 <br />4. Division 2, Chapte!' 5.5 and Chapter 6 <br />SAN JOAQUIN COUNTY ORDINANCES NUMBERED: 324, 441, 648, 662, 672, 695, 700, 860, 892, 3359, and 3675. <br />2. It is ιιnderstood and agreed by the PeΙ"mittee that the performance of any wo!'lc ιιnder this permit shall constitute an acceptance of aII tl1e <br />provisions contained herein and failιιre οη the Pel'mittee's part to comply with any provision will be caιιse for J'evocation of this pe1-π1it. <br />Except as otl1erwise provided for pιιblic agencies and ftancllise !1olde1·s, this pennit is !'evocable οη five days notice. <br />3. All work shall be done sιιbject to the sιιpervision ofand the satisfaction ofthe gι·antoι-. The Penηittee shall at all times during tl1e progress <br />ofthe wo1·Ic lceep the Coιιnty Highway ίη as neat and clean condition as is possible and upon completion ofthe worlc authorized herein, <br />shall leave the County High,vay ίη a thoroughly neat, clean and ιιsable condition. <br />4. TJ1e Permittee also agrees by the acceptance ofthis permit to pΙΌperly maintain any enc!'oachrnent structure placed by the Permittee οη any <br />part ofthe County Highway and to iωmediately !'epair any daωage to any p01·tion ofthe highway, which occurs as a resnlt ofthe <br />ιηaintenance ofthe said encroachrnent structure, until such tiωe as the Perωittee 1nay be relieved oftl1e !'esponsibility for sucl1 maintenance <br />by the County of San J oaquin. <br />5. The Peπnittee also ag!'ees by the acceptance oftl1is peπnit to ωake, at its own expense, such repairs as may be deemed necessary by the <br />County Departιnent of Public Works. <br />6. It is fu11her agreed by the Pennittee that whenever construction, reconstrυction or ωaintenance work upon the highway is necessary, the <br />installation provided for herein shall, upon request ofthe County Depaiiment of Public Works, be immediately 111oved 01· !'eωoved by and <br />at the sole expense ofthe Pennittee. <br />7. Νο ωaterial used for fill or baclcfill ίη the construction ofthe encroachrnent shall be boπowed οι· talcen from within the County right of <br />way. <br />8. All wo!'k shall be plaήned and caπied out with as little inconvenience as possible to the traveling public. Νο material shall be stacked <br />within eight feet (8') ofthe edge ofthe pavement or traveled way unless otherwise pΙΌνίded herein. Adequate pωvision shall be made fol' <br />the pωtection of the traveling public. Traffic control standards shall be utilized including baπicades; approved signs and lights; and <br />flagmen, as required by the particular work ίη progΙ"ess . <br />9. The Permittee, by the acceptance ofthis peπnit, shall assume fίι!Ι !'esponsibility for all liability for personal injury or damage to propel'!y <br />which may aΓise out ofthe work hel'ein peπnitted or which may arise out ofthe failure ofthe part ofthe Peπnittee to prope1·ly perfo1·m the <br />woι·k pΙΌvided undeι-this permit. Ιη tl1e event any claim ofsucl1 liability is made against the County ofSan Joaquin 01· any depart1nent, <br />official 01· employee theι·eof, the Peιmittee shall defend, indemnify, and hold each όfthem harmless for such c]aim. <br />10 . All baclcfill material is to be moistened as necessa!'y a11d thoωugl1ly compacted with mechanical mea11s. Ifl'equired by the County Director <br />of Public Woι·ks, such baclcfill shall consist of grave] or cωshed ωck. The Pennittee shall maintain the surface ove!' stωctu!'es placed <br />he!'eυnder as may be necesSaIΎ to insuΓe the !'etuι"Π ofthe ωadway to a completely stable condition and until ι·elieved ofsuch J"esponsibility <br />by the Coιιnty Department of Pυblic Woι·Ics. Whereveι· a g1·avel, cωsl1ed rock or asphalt suι-face is rernoved 01· darnaged ίη the course of <br />w01-Jc !'elated to tl1e peπnitted encωachn1ent, such material shall either be sepai·ately stored a11d Ieplaced ίη the roadway as near]y as <br />possible ίη its origina] state or shall be !'eplaced ίη Jcind, a11d the roadway shall be left ίη at least as good a condition as it was bef01·e the <br />comιnencement of opeι·ations ofp]acing the encωac]11nent struct1l!'e. <br />11. WheneνeΓ it becomes necessaIΎ to secιιι·e peinιission ftom abutting pΙΌpel'!y owneι·s for the pωposed wol'k, such authoι·ity rnust be secω·ed <br />by t]1e Permittee pΙ"iοι· to starting wol'k. <br />12. The cιnτent a11d future safety and convenience ofthe traveling public shall be given eνeΙΎ consideration ίη tl1e location a11d methods of <br />constωction utilized. <br />13. The Pennittee is responsible f01· the p!'eseι·vation ofsurvey monuments located within the area ofwol'lc l1e!'eίn pe!'mitted. Prior to the sta!'t <br />of construction, su1·vey monuments that potentia1ly ιnay be distu!'bed sl1all be located a11d referenced by a Licensed Land Sιπveyor, a11d a <br />CoJΏeι· Record fi]ed ν;ith tl1e Coιιnty Sιιrvey01·. Any Suι-vey Monιιments disturbed dιπing tl1e coιπse of constrυction shall be J"eestablished <br />by a Licensed La11d Survey01· a11d anotl1e!' CoJΏeι· RecoJ"d filed wit]1 tl1e County Su!'veyoι-.
