<br />3. THE INTENT IS THAT THESE PLANS REQUIRE ALL LABOR AND MATERIALS (EXCEPT
<br />AS SPECIFIED IN THE SPECIFICATIONS) NECESSARY AND PROPER FOR THE WORK
<br />CONTEMPLATED AND THAT THE WORK BE COMPLETED IN ACCORDANCE WITH

<br />5. ATTENTION IS DIRECTED TO SECTION 1540 (A)(1) OF THE CONSTRUCTION SAFETY
<br />ORDERS (TITLE 8 CALIFORNIA ADMINISTRATION CODE SECTION 1540), ISSUED BY
<br />THE OCCUPATIONAL SAFETY AND HEALTH STANDARDS BOARD PURSUANT TO THE
<br />CALIFORNIA OCCUPATIONAL SAFETY AND HEALTH ACT OF 1973, AS AMENDED,
<br />WHICH STATES:
<br />PRIOR TO OPENING AN EXCAVATION, EFFORT SHALL BE MADE TO DETERMINE
<br />WHETHER UNDERGROUND INSTALLATION: I.E., SEWER, WATER, FUEL, ELECTRIC
<br />LINES, ETC., WILL BE ENCOUNTERED AND, IF SO, WHERE SUCH UNDERGROUND
<br />INSTALLATIONS ARE LOCATED. WHEN THE EXCAVATION APPROACHES THE
<br />APPROXIMATE LOCATION OF SUCH AN INSTALLATION, THE EXACT LOCATION SHALL
<br />BE DETERMINED BY CAREFUL PROBING OR AND DIGGING; AND WHEN IT IS
<br />UNCOVERED, ADEQUATE PROTECTION SHALL BE PROVIDED FOR THE EXISTING
<br />INSTALLATION. ALL KNOWN OWNERS OF UNDERGROUND FACILITIES IN THE AREA
<br />CONCERNED SHALL BE ADVISED OF PROPOSED WORK AT LEAST 48 HOURS PRIOR
<br />TO THE START OF ACTUAL EXCAVATION.
<br />6. PROVIDE SHORING, BRACING, SLOPING OR PROVISIONS TO PROTECT WORKERS
<br />FOR ALL AREAS TO BE EXCAVATED TO A DEPTH OF FIVE FEET OR MORE. SAID
<br />PROTECTION TO BE DONE IN ACCORDANCE WITH THE REQUIREMENTS OF LOCAL,
<br />STATE, AND FEDERAL REGULATIONS (CAL -OSHA, OSHA).
<br />7. ASBESTOS CEMENT MATERIALS SHALL NOT BE USED IN THE CONSTRUCTION OF
<br />ANY FACILITIES WITHIN THIS PROJECT.
<br />8. CONTRACTOR SHALL PRESERVE AND PROTECT ALL EXISTING IMPROVEMENTS AND
<br />UTILITIES UNLESS OTHERWISE DIRECTED IN THE CONTRACT DOCUMENTS.
<br />9. PRIOR TO COMMENCEMENT OF WORK CONTRACTOR SHALL LOCATE AND
<br />REFERENCE ALL EXISTING MONUMENTS AND/OR PROPERTY CORNERS WITHIN THE
<br />LIMITS OF WORK.

<br />SECTION 8771 OF THE CALIFORNIA BUSINESS AND PROFESSIONS CODE
<br />(PROFESSIONAL LAND SURVEYORS ACT) PROVIDES DIRECTION FOR THE
<br />PROTECTION, REPLACEMENT, AND/OR PERPETUATION OF BOUNDARY, RIGHT OF
<br />WAY AND 0TH ER SURVEY CONTROL MONUMENTS. CONTRACTOR SHALL PRESERVE
<br />AND PROTECT ALL EXISTING PROPERTY CORNERS AND MONUMENTS. IT IS THE
<br />CONTRACTOR'S RESPONSIBILITY TO RESET AND/OR REPLACE PROPERTY CORNERS
<br />AND/OR MONUMENTS THAT ARE DAMAGED OR DESTROYED DURING
<br />CONSTRUCTION. THE CONTRACTOR SHALL REFER TO THE SPECIAL PROVISIONS,
<br />SECTION 5-1.36D SURVEY MONUMENTS.
<br />OBTAIN ALL PERMITS AND LICENSES REQUIRED FOR THE CONSTRUCTION AND
<br />COMPLETION OF PROJECT.
<br />ALL WORK IN THE PUBLIC RIGHT-OF-WAY IS SUBJECT TO THE APPROVAL AND
<br />ACCEPTANCE OF SAN JOAQUIN COUNTY PUBLIC WORKS DEPARTMENT.
<br />13. COORDINATE THE REMOVAL AND/OR RELOCATION OF ALL EXISTING UTILITIES IF

<br />PERPENDICULAR TO OR RADIALLY OPPOSITE CENTERLINE STATIONS, UNLESS
<br />OTHERWISE NOTED.
<br />17. DEMOLISH, EXCAVATE, REMOVE AND DISPOSE OF ANY EXISTING CONCRETE OR
<br />ASPHALT CONCRETE PAVING, CONCRETE CURB, GUTTER AND SIDEWALK AND
<br />DELETERIOUS MATERIAL AS REQUIRED TO CONSTRUCT THE CONTRACT WORK,
<br />DISPOSE OF ALL EXCESS MATERIAL GENERATED BY DEMOLITION, EXCAVATION AND
<br />GRADING.
<br />18. ASSUME SOLE AND COMPLETE RESPONSIBILITY FOR JOBSITE CONDITIONS DURING
<br />THE COURSES OF CONSTRUCTION OF THIS PROJECT, INCLUDING SAFETY OF ALL
<br />PERSONS AND PROPERTY, THAT THIS REQUIREMENT SHALL APPLY CONTINUOUSLY
<br />AND NOT BE LIMITED TO NORMAL WORKING HOURS, AND DEFEND, INDEMNIFY AND
<br />HOLD THE CITY, COUNTY AND THE ENGINEER HARMLESS FROM ANY AND ALL
<br />LIABILITY, REAL OR ALLEGED, IN CONNECTION WITH THE PERFORMANCE OF WORK
<br />ON THIS PROJECT, EXCEPTING FOR LIABILITY ARISING FROM THE SOLE
<br />NEGLIGENCE OF THE OWNER OR THE ENGINEER.
<br />CONSTRUCTION NOTES:
<br />1. LAYOUT IMPROVEMENTS FROM THE DIMENSIONS SHOWN ON THE PLANS. ANY
<br />CLARIFICATION ON CONFLICTS, DISCREPANCIES OR AMBIGUITIES SHOULD BE
<br />DIRECTED TO THE ENGINEER PRIOR TO THE CONSTRUCTION OF THE
<br />IMPROVEMENTS.
<br />2. MATCH EXISTING SURROUNDING LANDSCAPE AND OTHER IMPROVEMENTS WITH A
<br />TRANSITION IN PAVING, CURBS, GUTTERS, SIDEWALKS, GRADES, ETC., AND TO
<br />AVOID ANY ABRUPT OR APPARENT CHANGES IN CROSS SLOPES, LOW SPOTS OR
<br />HAZARDOUS CONDITIONS.
<br />3. WHERE PAVEMENT IS TO BE EXTENDED OR REMOVED, EXISTING PAVEMENT SHALL
<br />BE SAW -CUT OR GROUND TO A NEAT LINE PRIOR TO PLACING NEW ASPHALT
<br />CONCRETE.
<br />4. ALL NEW CONCRETE FLATWORK SHALL BE DRILLED AND DOWELED AND/OR KEYED
<br />INTO EXISTING FLATWORK IN ACCORDANCE WITH COUNTY STANDARD PLANS AND
<br />SPECIFICATIONS.
<br />5. THE CONTRACTOR SHALL PROVIDE AND MAINTAIN TEMPORARY SIGNS FOR ALL
<br />REGULATORY TRAFFIC SIGNS REMOVED DURING THE CONSTRUCTION.

<br />8. MAINTAIN A NEATLY MARKED SET OF FULL-SIZED AS -BUILT RECORD DRAWINGS
<br />SHOWING THE FINAL LOCATION AND LAYOUT OF ALL STRUCTURES AND OTHER
<br />FACILITIES. WHERE NECESSARY, SUPPLEMENTAL DRAWINGS SHALL BE PREPARED
<br />AND SUBMITTED BY THE CONTRACTOR.
<br />9. PRIOR TO ACCEPTANCE OF THE PROJECT, THE CONTRACTOR SHALL DELIVER TO
<br />THE ENGINEER, ONE SET OF NEATLY MARKED AS -BUILT RECORD DRAWINGS
<br />SHOWING THE INFORMATION REQUIRED ABOVE.
<br />10. DUST CONTROL SHALL BE PROVIDED AT ALL TIMES, AT THE CONTRACTOR'S
<br />EXPENSE, TO MINIMIZE ANY DUST NUISANCE AND SHALL BE IN ACCORDANCE WITH
<br />THE SPECIAL PROVISIONS.
<br />11. FINAL PAVEMENT WORK SHALL NOT OCCUR WITHIN THE ROAD RIGHT-OF-WAY
<br />PRIOR TO COMPLETION OF UTILITY RELOCATION WITHOUT SPECIFIC APPROVAL OF
<br />THE SJCO DIRECTOR OF PUBLIC WORKS.
<br />12. ANY CHANGES TO THE APPROVED IMPROVEMENT PLANS AND SPECIFICATIONS
<br />MUST BE PREPARED AND CERTIFIED BY THE "CIVIL ENGINEER", AND SHALL BE
<br />SUBMITTED TO THE SJCO DIRECTOR OF PUBLIC WORKS FOR APPROVAL PRIOR TO
<br />CONSTRUCTION.
<br />13. WHENEVER PAVEMENT IS BROKEN OR CUT IN THE INSTALLATION OF THE WORK
<br />COVERED BY THE SPECIFICATIONS, THE PAVEMENT SHALL BE REPLACED AFTER
<br />PROPER BACKFILLING WITH PAVEMENT MATERIALS EQUAL TO OR BETTER THAN
<br />THE MATERIALS USED IN THE ORIGINAL PAVING.
<br />14. DRAINAGE FACILITIES SHALL BE MAINTAINED DURING PERIODS OF INCLEMENT
<br />WEATHER, AND RESTORED TO THEIR ORIGINAL CONDITION UPON COMPLETION OF
<br />THE WORK.
