All construction materials and workmanship shall conform to the current SanJoaquin County Standards and Construction Specifications and the latest editionof the State Standard Specifications unless specifically shown otherwise on theseplans.2. The Contractor shall make an on-site inspection prior to providing any proposalsto determine any and all construction items which may be necessary to performa complete and acceptable job.3. Baumbach and Piazza, Inc. (Engineer) will not be responsible for or liable for anyunauthorized changes to or uses of these plans. All changes to these plans shallbe in writing and must be approved by the Engineer. The Contractor shall beresponsible for reporting all conflicts, errors, omissions, etc. to the Engineerimmediately upon discovery. If so directed by the Engineer, the Contractor shallstop work until mitigations can be made. Any costs incurred resulting from theContractor's failure to stop as directed, shall be the responsibility of theContractor.4. It is agreed that field conditions may require changes to these plans. A writtenestimate for cost of changes shall be prepared by Contractor and approved byOwner prior to making changes. Contractor agrees that he shall assume soleand complete responsibility for job site conditions during the course ofconstruction of the project, including safety for all persons and property; thatthis requirement shall apply continuously and not be limited to normal workinghours; and that the Contractor shall defend, indemnify and hold the Owner, andEngineer harmless from any and all liability, real or alleged, in connection withthe performance of work on this project, excepting for liability arising from thesole negligence of the Owner or Engineer.5. Construction staking (if required) shall be done by a Registered Civil Engineer orLicensed Land Surveyor. These Improvement Plans have been prepared with theintent that the firm of Baumbach & Piazza, Inc. will be performing anyconstruction staking required for the project. If, however, another engineeringand/or surveying firm should be employed to use these plans for the purpose ofconstruction staking, notice is hereby given that the firm of Baumbach & Piazza,Inc. will not assume any responsibility for errors or omissions if any, which mightoccur and which could have been avoided, corrected or mitigated if Baumbach &Piazza, Inc. had performed the staking work, or if Baumbach & Piazza, Inc. hadbeen contacted prior to staking regarding any questions of ambiguity in theplans, interpretation of the plans, or engineering inconsistencies contained inthese plans.6. Water used in any phase of construction, such as grading, compaction, dustcontrol, testing or other work herein required, shall be included in the unit priceor lump sum bid for the respective item of construction or items of work.7. Existing underground utilities were plotted from available records. Existingunderground utilities shall be protected. The Contractor shall be responsible forcontacting all utility agencies to mark their utilities in the field at least 48 hoursbefore excavation. Completeness and accuracy of existing utility locations shownin these plans are not guaranteed. Call "USA" (800) 227-2600.8. The Contractor agrees that he shall assume sole and complete responsibility forjob site conditions during the course of construction of this project; that thisrequirement shall apply continuously and not be limited to normal working hours;and that the Contractor shall defend, indemnify and hold harmless the Ownerand the project engineer from any and all claims of litigation, damages andattorney's fees for personal or property damage of whatever nature which areclaimed to have occurred during the term of this project.9. Contractor shall notify San Joaquin County Utility Mantenance (209) 468-3090prior to connecting to existing water conveyance system and for inspection priorto backfilling any trenches/connections. Any water service installation work shallnot interrupt existing water conveyance system.GENERAL NOTESSTAKING NOTES1. Baumbach and Piazza, Inc. (Engineer) shall set all survey controls andconstruction stakes as necessary for completion of work. The Contractorshall be responsible for the preservation of all survey and constructionstakes. Survey and construction stakes that are lost or destroyed due toContractor's negligence will be set by the Engineer at the Contractor'sexpense.2. When requesting construction stakes, the Contractor is required to notifyBaumbach & Piazza 48 hours in advance of our crews beginning work. Itis the Contractor's responsibility to schedule construction staking aminimum of 48 hours prior to commencement of any construction.Engineer assumes no responsibility for any costs incurred for constructionshutdowns or delays when not given this advance notice.3. The Contractor shall be responsible for the protection of all existingsurvey monuments and other survey markers during construction. Allsuch monuments or markers destroyed or lost during construction shallbe replaced at the Contractor's expense and will require 48 hours noticefrom the Contractor to replace said monuments.4. The Contractor shall not perform any work due to staking error withoutfirst consulting with the Engineer. In the event the cost of any item ofcorrective work exceeds $500.00, permission to proceed must bereceived in writing from the Engineer. No liability will be assumed by theEngineer for the costs of work performed in violation of this provision.5. Certain utility locations are dimensioned from "back of walk" or "back ofcurb." Those utilities such as but not limited to, fire hydrants, water andsewer services, street lights and utility boxes will be referenced to backof walk or back of curb. It is the responsibility of the contractor to alignthese utilities so as not to create an encroachment upon sidewalk and/orcurb and gutter placement.6. Whenever the note "verify" is indicated on these plans, the Contractorshall expose these facilities prior to the start of any construction. Afterthe Contractor has completed exposing said facilities, he shall notify theEngineer and request they verify that the horizontal, vertical alignments,measurements, etc., are in substantial conformance with these plans tothe Engineer's satisfaction. In the event that said facilities aredetermined not to be in substantial conformance, the Engineer reservesthe right to revise these plans to reflect their found conditions. Thefollowing is a partial list of items to be verified:A. All drainage connection points.B. All sewer connection points.C. All water connection points.7. If the site is not staked by the Engineer, the surveyor shall providewritten confirmation to the Engineer that all utility tie-in points have beenverified prior to any construction.8. If any construction staking is done by someone other than Baumbach &Piazza, Inc., notice is hereby given that the firm of Baumbach & Piazza, Inc.or the Owner will not assume any responsibility for errors or omissions if any,which might occur and which could have been avoided, corrected or mitigatedif Baumbach & Piazza, Inc. had performed the staking work, or if Baumbach &Piazza, Inc. had been contacted prior to staking regarding any questions ofambiguity in the plans, interpretation of the plans, or engineeringinconsistencies contained in these plans.DUST CONTROL NOTES1. Contractor shall take all necessary precautions to keep dust to aminimum. Cost to be included in other items of work.2. Dust Control is the Contractors sole responsibility when working on-site,and all dust control work shall be included in the bid. The Contractorshall also water the site, as an extra, when requested by the City or theOwner.3. All motors shall be kept properly tuned and maintained.4. Earth moving activities shall cease if wind exceeds 20 mph average overone hour.5. On-site vehicle speeds shall be limited to 15 mph.6. All areas with vehicle traffic should be watered periodically forstabilization of dust emissions.7. The area disturbed by clearing, earth moving or excavation activitiesshould be minimized at all times.8. All material transported on or off-site shall either be sufficiently wateredor securely covered to prevent excessive amount of dust.9. When conditions are dry, all material excavated or graded shouldsufficiently watered to prevent excessive amount of dust. Wateringshould occur at least twice a day with complete coverage, preferably inthe late morning and after work is done for the day.10.
