EXHIBIT "C" <br />is is a non-exclusive easement. Parcel "2" Two shall be allowed to plant trees, <br />shrubs, plants or crops, farm, graze, park vehicles or equipment and otherwise <br />make any use of the surface of easement area other than the erection of any <br />buildings. No portion or part of the pipeline may rise to within 3 feet of the <br />surface of the easement. No meters or other surface protrusions shall be allowed <br />on the easement from any pipeline. This easement does not provide Parcel "1" <br />One with any right to alter the surface of the easement other than in the course <br />of installation, repair or replacement of a pipeline. ' If a pipeline is installed, <br />repaired or replaced in the easement it is the responsibility of Parcel "1" One to <br />return the surface to the same grade, slope, surface and condition that existed <br />prior to installation of a pipeline. Parcel "1" One shall be allowed entry onto the <br />easement area only for purposes of installation, inspection, maintenance and <br />repair of a pipeline. Except in case of emergency Parcel "1" One shall provide at <br />least 48 hours' notice to the owner or owners of Parcel "2" Two prior to any entry <br />onto the easement. If entry is necessary in an emergency notice shall be provided <br />to the owner of Parcel "2" Two immediately after such entry. Parcel "1" One is <br />not required to provide gates or access points between Parcel " I"One and Parcel <br />"2" Two and may maintain a fence at these locations." <br />
