The Per mittee shall at all ti mes duri n g t he pro gress of t he work keep t he Cou nt y Hi gh wa y i n as neat an d clean co nditio n as is p ossible an d upon co mpleti o n of t he work aut h orized herein, shall leave t he Co unt y Hi gh wa y i n a t horou ghl y neat, clean an d usable co nditio n. 4. The Per mittee also agrees b y t he acceptance of t his per mit t o properl y mai ntai n an y encroach ment struct ure placed b y t he Per mittee o n an y part of t he Cou nt y Hi gh wa y an d to i m mediatel y repair an y da ma ge t o an y p ortio n of t he hi gh way, which occurs as a result of t he mai ntenance of t he sai d encroach ment struct ure, u ntil such ti me as t he Per mittee ma y be relie ved of t he resp o nsibilit y for such mai ntenance b y t he Co u nt y of San Joaqui n. 5. The Per mittee also agrees b y t he acceptance of t his per mit t o ma ke, at its o wn expense, such repairs as ma y be dee med necessar y b y t he Co u nt y Depart ment of P ublic Works. 6. It is furt her agreed b y t he Per mittee t hat whenever co nstructi o n, reco nstructio n or mai ntenance work u po n t he hi gh wa y is necessar y, t he i nstallati on pro vi ded for herei n shall, up on req uest of t he Cou nt y Depart ment of P u blic Works, be i m mediatel y mo ved or re mo ved b y an d at t he sole expense of t he Per mittee. 7. No material used for fill or backfill i n t he constructio n of t he encroach ment shall be b orro wed or taken fro m wit hi n t he Co unt y ri ght of wa y. 8. All work shall be planned an d carried out wit h as little i ncon venience as p ossi ble t o t he traveli n g p ublic. No material shall be stacked wit hi n ei ght feet (8') of t he ed ge of t he pave ment or traveled wa y u nless ot her wise pro vi ded herei n. Adeq uate pro visi on shall be made for t he protecti on of t he traveli n g pu blic. Traffic co ntrol stan dards shall be utilized incl udi n g barricades; ap pro ved si gns and li ghts; and fla g men, as req uired b y t he particular work i n pro gress. 9. The Per mittee, b y t he acceptance of t his per mit, shall assu me full resp o nsibilit y for all liabilit y for perso nal inj ury or damage t o pro perty which ma y arise o ut of t he work herei n per mitted or which ma y arise o ut of t he fail ure of t he part of t he Per mittee t o properl y perfor m t he work pro vi ded un der this per mit. In the event an y clai m of such liabilit y is made agai nst t he Co unt y of San Joaqui n or an y depart ment, official or e mpl o yee t hereof, t he Per mittee shall defen d, i nde mnify, an d h ol d each of t he m har mless for such clai m. 1 0. All backfill material is t o be moistened as necessar y an d t h oro u ghly co mpacted wit h mechanical means. If req uired b y t he Co u nt y Direct or of P u blic Works, such backfill shall co nsist of gravel or crushed rock. The Per mittee shall mai ntai n the surface o ver struct ures placed hereu n der as ma y be necessar y t o i nsure the ret urn of t he road wa y t o a co mpletel y stable co n diti on an d u ntil relieved of such respo nsibilit y b y t he Co u nt y Depart ment of P u blic Works. Where ver a gra vel, crushed rock or asp halt surface is re mo ved or da maged i n t he course of work related t o t he per mitted encroach ment, such material shall eit her be separatel y st ored an d replaced i n t he road wa y as nearl y as p ossi ble i n its ori ginal state or shall be replaced in ki nd, an d the road wa y shall be left i n at least as go o d a con diti on as it was before t he co m mence ment of o perati o ns of placi n g t he encroach ment struct ure. 1 1. Whenever it beco mes necessar y t o secure per missi o n fro m ab utti ng an d/ or u nderl yi n g pro pert y o wners for t he prop osed work, such aut h orit y must be secured b y t he Per mittee pri or to startin g work. 1 2. The current an d future safet y an d co n venience of t he traveli n g p ublic shall be gi ven ever y co nsi derati o n in the l ocatio n an d met h o ds of co nstructio n utilized. 1 3. The Per mittee is resp o nsi ble for the preservati o n of survey mo n u ments l ocated wit hi n t he area of work herei n per mitted. Prior to the start of co nstructi on, survey mo n u ments t hat potentiall y ma y be dist urbed shall be l ocated an d referenced b y a Licensed Lan d S urve yor, and a Corner Record filed wit h t he Count y S urve yor. An y S urve y M o n u ments dist urbed d urin g t he course of co nstructio n shall be reestablished b y a Licensed Lan d S urve yor an d an other Corner Record filed wit h t he Cou nt y S urveyor.
