al - ion ES <br />Conditions of Approval <br />Planning & Engineering Division: Standard Conditions of Approval <br />1. Comply with all applicable Federal, State, County and City codes, regulations and <br />adopted standards and pay all applicable fees. <br />2. The property owners, developers and/or successors -in -interest (ODS) shall be <br />responsible for the City's legal and administrative costs associated with defending <br />any legal challenge of the approvals for this project or its related environmental <br />document. <br />3. In order to minimize any adverse financial impact on the City of Stockton (COS) <br />associated with development and/or use of the subject site, the ODS agrees that it <br />will not challenge or protest any applicable fees associated with the development of <br />the site, but if such fees are amended or modified, the ODS agrees to pay such fees <br />as they may be amended or modified from time to time. <br />4. Protect any existing survey monuments, which include but not limited to property pins <br />and chiseled cross marks. <br />5. The property owners, developers, and/or successors shall dedicate to the City the <br />necessary right-of-way in order to fit City Standard frontage improvements. <br />6. The owner/applicant shall upgrade the existing ADA curb ramp located at the <br />northeast corner of Harvey and Clayton to the City's current standard. <br />7. The owner/applicant shall remove and replace the cracked/displaced curb, gutter, <br />and sidewalk on Harvey St. The said removal and replacement shall conform to the <br />City of Stockton Standard Plans and Specifications <br />8. The owner/applicant shall remove stumps adjacent to the site. <br />9. Driveway access to the site shall conform to the City of Stockton Standard Plans and <br />Specifications. <br />Building Division Conditions of Approval: <br />1. SB5 finding is required. Based on the effective map, the finding in SMC Section <br />16.90.020(A)(5) may be applied, as the property is located in an area of potential <br />flooding of three (3) feet or less from a storm event that has a 1-in-200 chance of <br />occurring in any given year, from sources other than local drainage, in urban and <br />urbanizing areas. <br />2. The ODS shall provide access and/or utility easements between parcels. <br />Municipal Utilities Division Conditions of Approval: <br />3. Any on -site wells and septic tanks shall be abandoned and destroyed prior to <br />recordation of any final map.
