<br />being first duly sworn, deposes and ,says: That at all times hereinafter
<br />mentioned he was a citizen of the United States, over the age of eighteen
<br />years, and a resident of said County, and was at and during all said times
<br />the principal clerk of the printer and published of the Stockton Daily
<br />Independent, a newspaper of general circulation printed and published
<br />daily in the City of Stockton, in said County of San Joaquin, State of Cali-
<br />fornia; that said Stockton Daily Independent is and was at all times here-
<br />in mentioned, a newspaper of general circulation as that term is defined
<br />by Section 4460 of the Political Code; and, as provided by said section, is
<br />published for the dissemination of local and telegraphic news and intelligence
<br />of a general character, having a bona -fide subscription list of paying sub-
<br />scribers, and is not devoted to the interests or published for the enter-
<br />tainment or instruction of a particular class, profession, trade, calling, race
<br />or denomination, or for the entertainment or instruction of any number of
<br />such classes, professions, trades, calling, races or denominations; that at all
<br />said times said newspaper had been established, printed and published
<br />in the said City of Stockton, in said County and State, at regular intervals,
<br />for more than one year preceding the first publication of the notice herein
<br />mentioned; that said notice was set in type not smaller than nonpareil and
<br />was preceded with words printed in black face type not smaller than non-
<br />pareil, describing and expressing in general terms the purport and character

<br />Notice is hereby given that on
<br />the 25th day of January, 1926, a po-
<br />tation was filed with the Board of
<br />Supervisors of the County of San
<br />Joaquin, State of California, signed
<br />by ten (10) freeholders of the Coun-
<br />ty of San Joaquin, Stato of Califor-
<br />nia, at least two of said petitioners
<br />being residents of Road District No.
<br />One, in which Road District No. One
<br />the property affected is situated,
<br />and all of whom are taxable in said
<br />Road District No. One for toad pur-
<br />poses, praying for an drder vacat-
<br />ing, discontinuing, abandoning, and
<br />abolishing a portion of the A. S.
<br />Drais Road No,. 326, a public high-
<br />way in said Road District No. One
<br />of said San Joaquin County, which
<br />portion of said road is more par-
<br />ticularly described as follows:
<br />All that portion of the following
<br />described right-of-way lying East
<br />of a line 30 feet East of the I/j, sec-
<br />tion line North and South in Sec-
<br />tion 10, Twp. 1 N., R. 8 E., M. D. B.
<br />& M.:
<br />Commencing at a point on the
<br />center line of the A. S. Drais Road
<br />No. 326, which is 166 feet South of
<br />the center of Section 10, Twp. 1 N..
<br />R. 8 E., and run thence for the
<br />center line of a 60-foot right-of-
<br />way South 31°-16' E. 139.7 feet,
<br />thence South 26'-5' west 165.8.feet
<br />to the center of said A. S. Drais
<br />Road No. 326.
<br />That on said 25th day of January
<br />1926, said Board of Supervisors a
<br />the County of San Joaquin, State of
<br />-California, did, by itq order duly
<br />made and entered upon the minutes
<br />of said Board, fix Monday, the 15th
<br />day of. February. 1926. at the hour
<br />of 11 o'clock a. m. of said day, at the '
<br />meeting place of said Board of Su-
<br />pervisors in the Courthouse in .the
<br />City of Stockton, County of San
<br />Joaquin, State of California, as tho
<br />time and place for hearing said pe-
<br />tition above referred to, at which
<br />time said Board of Supervisors will
<br />hear the evidence offered by any
<br />party interested, relating to the
<br />present or prospective public use of
<br />that portion of the A. S. Drais Read
<br />No. 326 above described and as de-
<br />scribed and set forth in said peti-
<br />tion.
<br />All persons are, therefore, notiflod
<br />by said Board of Supervisors of the
<br />County of San Joaquin, Stale Of
