353150-G <br />2. Department acknowledges County's title to County's <br />Easement in said Area'of Common Use and the priority of County's <br />title over the title of Department therein. County has and <br />reserves the right and easement to use in common with Department's <br />use of said Department's facilities, said Area of Common Use for <br />all of the purposes for which County's Easement was acquired, <br />without need for any further permit or permission from Department. <br />Except in emergencies, County shall give reasonable notice to <br />Department before.performing any work on County's facilities in <br />said Area of Common Use. <br />3. In the event that the future use of said Area of <br />Common Use shall at any time or times necessitate a rearrangement, <br />relocation, reconstruction or removal of any of County's facili- <br />ties then existing in said Area of Common Use and Department shall <br />notify County in writing of such necessity and agree to reimburse <br />County on demand for its costs incurred in complying with such <br />notice, County will provide Department with plans of its proposed <br />rearrangement and an estimate of the cost thereof and, upon approval. <br />of such plans by Department, County will promptly proceed to <br />effect such rearrangement, relocation, reconstruction, or removal. <br />If such rearrangement shall require the relocation of any of County's <br />facilities outside of said Area of Common Use, Department will <br />(1) enter into a Joint Use and Occupancy Agreement, covering the <br />new location of County's Easement within the Department right of <br />way,,(2) provide executed document(s) granting to County a good <br />and sufficient easement outside of the Department right of way if <br />
