07oo0602 <br />-2- <br />Department of Planning and Building Inspection dated July 25, <br />1986, finding that the proposed vacation and abandonment is in <br />conformance with the San Joaquin County General Plan, is on file <br />with this Board of Supervisors; and <br />WHEREAS, Pacific Gas and Electric Company has installed and <br />maintains public utilities facilities on said right of way for <br />which a public utilities easement will be reserved. <br />NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED and this <br />Board of Supervisors does hereby find and determine that said <br />roadway or portion thereof hereinbefore described is unnecessary <br />for present or prospective public use; that the rights -of -way or <br />parts thereof are not useful as a nonmotorized transportation <br />facility; that said vacation and abandonment will not cut off all <br />access to the property of any person adjoining said vacated and <br />abandoned roadway; and said public roadway or portion thereof <br />should be vacated and abandoned. <br />IT IS FURTHER ORDERED that the County of San Joaquin, State <br />of California, pursuant to Chapter 4 of the Public Streets, <br />Highways, and Service Easements Vacation Law (Streets and <br />Highways Code Section 8300-8363, inclusive), does hereby vacate <br />and abandon said roadway or portion thereof hereinbefore <br />described. <br />IT IS FURTHER ORDERED that the County of San Joaquin, State <br />of California, does hereby abandon said public roadway or portion <br />thereof hereinbefore described except that there shall be <br />reserved to the Pacific Gas and Electric Company an easement and <br />the right at any time, or from time to time, to construct, <br />install, inspect, maintain, replace, remove, and use facilities <br />of the type hereinafter specified: poles, aerial wires, cables, <br />electrical conductors with associated crossarms, braces, <br />transformers, anchors, guy wires and cables, fixtures and <br />appurtenances, including ingress thereto and egress therefrom, <br />over and across the following described portion of highway or <br />part thereof hereby abandoned: <br />A 60-foot wide strip, measured at right angles and <br />contiguous to the southerly line of Dodds Road, entirely <br />across the northerly portion of highway hereby abandoned. <br />IT IS FURTHER ORDERED that the title to the lands previously <br />subject to the easement for the public roadway or portion thereof <br />hereinbefore described shall hereby revert to the respective <br />owners thereof free from such public easement, and that the Clerk <br />of the Board of Supervisors shall cause a certified copy of this <br />Order, attested by the Clerk under the seal of the Board of <br />Supervisors, to be recorded in the office of the County Recorder <br />of San Joaquin County. <br />U <br />
