ZUKUMAS, San Joaquin County heretofore purchased a right-of-way <br />for a public highway across the Boggs Tract leading from the City <br />of Stockton westward to the San Joaquin River, which right-of-way <br />was a part of the proposed Jacobs Road leading from Stockton to <br />the Lower Division of Roberts Island, which road is a benefit to <br />the community and a public necessity; and, <br />wtimatu;AS, it is deemed advisable, in order to preserve the nav- <br />igability of Stockton Channel, that Mormon Channel should be dammed <br />and divert the watefs thereof across the Boggs Tract for a time, <br />and the preservation of the navigability of Stockton Channel is a <br />necessity; and, <br />WHEREAS, it is desirable that there should be no conflict be- <br />tween said two public necessities: <br />THEREFORE, in consideration of the premises and the sum of <br />One Dollar, the receipt whereof is b.ereby acknowledged, the Califor- <br />nia Reclaimed Lands Company, a corporation, hereby gives to the <br />County of San Joaquin the right to travel over and use as a public <br />highway the road belonging to said California Reclaimed Lands Com- <br />pany, leading from the Railroad Bridge at the foot of Main Streev, <br />Stockton, thence in a westerly direction around 'the south end of <br />the property of the Angel Iron Works to ;,he land of said California <br />Reclaimed Lands Company, thence over the easterly end of the lands <br />of said California Reclaimed bands Company to the levee south of <br />Mormon Channel on said land, thence in a westerly and northwesterly <br />direction on and over the levees on the lands of said Company south <br />of Mormon Channel and south of Stockton Channel. <br />It is understood that the County of San Joaquin can use this <br />right-of-way and travel -over the same as a highway during the t i3ne <br />that said right-of-way secured by the County from said Boggs is <br />rendered unfit for use as a highway by reason of the diversion of <br />Page 1. <br />36 <br />
