Whereas, by a certain deed executed July 3, 1906, wherein Prank <br />S. Boggs deeds to the County of.San Joaquin, State of California in <br />consideration of the sum of $1700 the following described piece of land <br />for road purposes, to -wit: A strip of land 60 feet in width, described <br />as follows: To be 60 feet in width from West Street to San Joaquin River, <br />commencing at the intersection of Washington and West Street in the city <br />of Stockton and following a westerly direction along the south side of the <br />right of way of the Southern Pacific Company, which right of way is set <br />forth in a certain agreement dated August 28, 1902 between said Southern <br />Pacific Company and Frank S. Boggs, said right of way to continue in a <br />Westerly course from the terminous of the said Southern Pacific Company's <br />right of way to the Fast Bank of the San Joaquin River at the point select- <br />ed by the Board of Supervisors of said County for the erection of a steel <br />draw -bridge across the San Joaquin River upon the said Jacobs road, and as <br />shown on a plat prepared by F. E. Quain, County Surveyor of said County,(/ <br />and attached to the agreement of said Prank S. Boggs made with Jacobs and <br />Flack and others interested in the construction of the Jacobs road, dated <br />Stockton, Cal., Mdy 10, 1905, said right of way from (he intersection <br />of West and Washington street shall continue easterly along said Washing- <br />ton street to Stockton street, thence Northerly along Stockton street from <br />its intersection with Washington.street to.the railroad bridge on Main <br />Street; and <br />Whereas, since the execution of the above mentioned right--of-way in <br />said deed.,that portion of the right-of-way within the city limits of the <br />city of Stockton, has been changed by the dedication of the streets and <br />avenues of the YoSemite Subdivision of the City of Stockton, as shown by <br />the official map and, ,plat of the City of Stockton, filed in the office <br />of the County Recorder of'San Joaquin County; and <br />Whereas, said streets above noted have been dedicated for public use <br />to the city of Stockton and should not be mentionedt in the above deed <br />as belonging to the County of San Joaquin and in lieu thereof the follow- <br />ing described deed should be executed to the County of San Joaquin, as <br />follows, to -wit: <br />A strip of land 60 feet in width described as follows: To be 60 feet <br />in width from West street of the city of Stockton, to the right bank of the <br />San Joaquin River. Commencing at the intersection of Washington and West <br />Streets of the city of Stockton, and following a westerly direction along <br />the south side of the might of way of the Southern Pacific Company, which <br />right of way is set forth in a certain agreement dated August 28, 1902, <br />between said Southern Pacific Company and Frank S. Boggs; said right of way <br />to continue in a Westerly course from the terminous of the said Southern <br />Pacific Company's right of way to the east bank of the San Joaquin River <br />.at the point selected by the Board of Supervisors of said County for the <br />erection of a steel draw -bridge across the San Joaquin River upon the said <br />Jacobs road, and as shown on a plat prepared by F. B. quail, County Sur- <br />veyor of said County; <br />Now, therefore, it is hereby ordered that the last above mentioned <br />deed be substituted for the first above mentioned deed, and that the <br />said deed be accepted by the County of San Joaquin. <br />Oupervisor.
