Hazelton Avenue <br /> Stockton, California 95205 <br /> Attention: Public Services Division <br /> ROAD MAINTENANCE AGREEMENT <br /> RELATED TO INSTALLED PIPELINE <br /> This Road Maintenance Agreement (the "Obligation") is signed this O day <br /> of ANG r , 201qby Bruce Persenaire and Joyce Persenaire (hereinafter referred to as <br /> "Obligors" <br /> WHEREAS, the Obligors are owners of APN: 227-020-26 (hereinafter referred to as <br /> "the Land") and have made an application for an encroachment permit with the San Joaquin <br /> County Department of Public Works (hereinafter referred to as"County") for the installation of <br /> a private pipeline under a section of County owned road known as Mahon Road(hereinafter <br /> referred to as"Road", as defined below). <br /> WHEREAS,this Obligation for repair and maintenance is a required condition for the <br /> approval of Encroachment Permit No. PS-1400022 with San Joaquin County for the installation <br /> of a private ten inch irrigation pipeline. <br /> Now, therefore, in consideration of the above, the Obligor hereto agrees as follows: <br /> 1. Description and Definition of"Road." The section of road to be maintained is a <br /> section of road situated between APN: 227-020-26 and APN: 227-020-31 starting at the <br /> intersection of the pipeline and the south side road right-of-way and continuing northerly parallel <br /> to the alignment of the installed pipeline for a distance of seven and a half feet to each side of the <br /> pipeline measured perpendicularly from the centerline of the pipeline alignment, as shown on the <br /> attached Exhibit"A"and incorporated herein by this reference. <br /> 2. Obligation. This Obligation for repair and maintenance is a required condition for <br /> the approval of Encroachment Permit No. PS-1400022.with San Joaquin County for the <br /> installation of a private 15 inch irrigation pipeline and as consideration for such, Obligors shall <br /> be responsible for the maintenance of said Road, including but not limited to the grading and <br /> resurfacing of the Road resulting from or related to the maintenance of said pipeline. An <br /> encroachment permit shall be required for all work within road right-of-way. <br /> 3. Maintenance Standard. The minimum improvement standard(s) shall be as <br /> otherwise set forth per the current San Joaquin County Improvement Standards. <br /> 1 <br />
