Dykxhoorn and Donna M. Dykxhoorn,husband and wife as Joint <br /> Tenants(hereinafter referred to as"Obligors"). <br /> WHEREAS,the Obligors are owners of APN 205-150-39(hereinafter referred to as"the <br /> Land")and have made an application for an encroachment permit with the San Joaquin County <br /> Department of Public Works(hereinafter referred to as"County") for the installation of a <br /> private pipeline under a section of County owned road known as Mariposa Road(hereinafter <br /> referred to as"Road",as defined below). <br /> WHEREAS,this Obligation for repair and maintenance is a required condition for the <br /> approval of Encroachment Permit No. PS-1402528 with San Joaquin County for the installation <br /> of a private twelve inch irrigation pipeline. <br /> Now,therefore, in consideration of the above,the Obligor hereto agrees as follows: <br /> 1. Description and Definition of"Road." The section of road to be maintained is a <br /> section of road situated between APN 205-150-10 and APN 205-150-39 starting at the <br /> intersection of the pipeline and the north side road right-of-way and continuing southwesterly <br /> parallel to the alignment of the installed pipeline for a distance of seven and a half feet to each <br /> side of the pipeline measured perpendicularly from the centerline of the pipeline alignment,as <br /> shown on the attached Exhibit"A" and incorporated herein by this reference. <br /> 2. Obligation. This Obligation for repair and maintenance is a required condition for <br /> the approval of Encroachment Permit No.PS-1402528 with San Joaquin County for the <br /> installation of a private 12"irrigation pipeline and as consideration for such,Obligors shall be <br /> responsible for the maintenance of said Road,including but not limited to the grading and <br /> resurfacing of the Road resulting from or related to the maintenance of said pipeline. An <br /> encroachment permit shall be required for all work within road right-of-way. <br /> 3. Maintenance Standard. The minimum improvement standard(s)shall be as <br /> otherwise set forth per the current San Joaquin County Improvement Standards. <br /> 1 <br />
