NOW, THEREFORE, BE IT RESOLVED that it is the finding of this Board of Supervisors <br /> that, as authorized by Section 10-2700 of the Ordinance Code of San Joaquin County, it is <br /> necessary for the protection of the public to grant permission to close the petitioned streets for <br /> the hours and dates requested and in future years for the purpose of parades and special <br /> services of the Our Lady of Fatima Society of Thornton. <br /> This action shall be subject to the following conditions: <br /> 1. That an Encroachment Permit, contingent on community support, shall be obtained <br /> from the Department of Public Works for the road closure. <br /> 2. That the performance of any procedure related to this Permit shall constitute an <br /> acceptance of all the provisions contained herein and failure on the APPLICANT'S <br /> part to comply with any provision will be cause for revocation of this Permit. <br /> 3. Provisions shall be made for the passage of local traffic. <br /> 4. That should emergency conditions arise during road closure period, temporary <br /> opening of road shall be implemented immediately by the APPLICANT. <br /> 5. That the APPLICANT shall furnish and maintain any and all traffic control devices <br /> necessary to ensure the protection of the traveling public in accordance with all <br /> Federal, State and County regulations including terms, conditions, and/or <br /> restrictions stated herein or attached hereto. <br /> 6. That the APPLICANT will immediately make such repairs or perform any necessary <br /> work as required to leave the specified portion of County highway in as neat, clean <br /> and usable condition as existed prior to encroachment. <br /> 7. That the APPLICANT will assume full responsibility for all liability for personal injury or <br /> damage to property which may arise out of the special road use described above, or <br /> which may arise out of failure to provide necessary safety described above, or which <br /> may arise out of failure to provide necessary safety devices and personnel. <br /> 8. That in the event any claim of such liability is made against the County of San Joaquin <br /> or any department, official or employee thereof, the APPLICANT shall defend, <br /> indemnify and hold them and each of them harmless of such claim. <br /> 9. That the APPLICANT agrees to furnish a certificate to County indicating that <br /> APPLICANT has, and is maintaining, liability insurance insuring against legal liability <br /> for bodily injuries and death, and for damages to property in the amount of <br /> $3,000,000. The above insurance shall be of the broad form coverage type. An <br /> additional insured endorsement to APPLICANT'S liability insurance policy naming <br /> County, its officers and employees as additional insureds shall be furnished County. <br /> Notwithstanding the above, APPLICANT'S liability insurance policy shall be endorsed <br /> as primary insurance. The certificate or policy of insurance shall state that COUNTY <br /> will be notified at least thirty (30) days before cancellation of the policy or any material <br /> change thereof. Adequate proof of insurance, in compliance with the above <br /> requirements, has been furnished to the Department of Public Works. <br /> 10.That should emergency conditions arise during the road closure period, temporary <br /> opening of road shall be implemented immediately by the APPLICANT. <br />
