BEFORE THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN JOAOUIN <br /> STATE OF CALIFORNIA <br /> RESOLUTION <br /> R-06- 697 <br /> RESOLUTION APPROVING TEMPORARY CLOSURE OF <br /> BENJAMIN HOLT DRIVE, BETWEEN LEESBURG PLACE AND HARRISBURG PLACE, <br /> ON THE FIRST SATURDAY OF MAY AND THE THIRD SATURDAY OF NOVEMBER, <br /> FOR A PARADE <br /> WHEREAS, Lincoln High School Music Boosters, hereinafter referred to as APPLICANT, has <br /> applied for permission to temporarily close Benjamin Holt Drive to traffic, between Leesburg Place <br /> and Harrisburg Place, for the hours from 8:30 a.m. to 2:30 p.m. on the first Saturday in May and the <br /> third Saturday in November for a parade. <br /> NOW THEREFORE, BE IT RESOLVED that it is the finding of this Board of Supervisors that, <br /> as authorized by Section 10-2700 of the Ordinance Code of San Joaquin County, it is necessary for <br /> the protection of the public to grant permission to close Benjamin Holt Drive, between Leesburg Place <br /> and Harrisburg Place on the first Saturday in May and the third Saturday in November for the purpose <br /> of a parade. <br /> This action shall be subject to the following conditions: <br /> 1. That the performance of any procedure related to this permit shall constitute an acceptance <br /> of all provisions contained herein and failure on the APPLICANT'S part to comply with any <br /> provision will be cause for revocation of this permit. <br /> 2. Provision shall be made for the passage of local traffic. <br /> 3. That should emergency conditions arise during road closure period, temporary opening of road <br /> shall be implemented immediately by the APPLICANT. <br /> 4. That the APPLICANT shall furnish and maintain any and all traffic control devices necessary to <br /> ensure the protection of the traveling public in accordance with all Federal, State,and County <br /> regulations including terms, conditions, and/or restrictions stated herein or attached hereto, <br /> and that the advance warning, road closed and detour signs may be made available by the <br /> COUNTY, and that the APPLICANT may contact the County Department of Public Works <br /> Traffic Division for the procedures on obtaining and installing said signs at least three days <br /> in advance of the signs being needed. <br /> 5. That the APPLICANT will immediately make such repairs or perform any necessary work as <br /> required to leave the specified portion of County Highway in as neat, clean, and usable <br /> condition as existed prior to encroachment. <br /> 6. That the APPLICANT will assume full responsibility for all liability for personal injury or damage <br /> to property, which may arise out of the special road use described above, or which may arise <br /> out of failure to provide necessary safety described above, or which may arise out of failure to <br /> provide necessary safety devices and personnel. <br /> 7. That in the event any claim or such liability is made against the County of San Joaquin or any <br /> Department, official or employee thereof,the APPLICANT shall defend, indemnify, and hold <br /> them and each of them harmless of such claim. <br />
