Description and Definition of"Road"and"Pipeline." Road is the section of road <br /> situated between APN 245-210-06 and APN 245-210-04 starting at the intersection of the <br /> Pipeline and the west side road right-of-way and continuing easterly parallel to the alignment of <br /> the Pipeline for a distance of seven and a half feet to each side of the pipeline measured <br /> perpendicularly from the centerline of the pipeline alignment(a total of fifteen feet). Pipeline is <br /> a private 6"pipeline. Both the Road and Pipeline are shown on the attached Exhibit"A"and <br /> incorporated herein by this reference. <br /> 2. Obligation.This Obligation for repair and maintenance is a required condition for <br /> the approval of Encroachment Permit No.PS-1403494 with San Joaquin County for the <br /> installation of the Pipeline and as consideration for such,Obligors shall be responsible for the <br /> maintenance of Pipeline and Road,including but not limited to the grading and resurfacing of the <br /> Road resulting from installation of Pipeline and/or related to the maintenance of Pipeline. <br /> Obligor shall obtain an encroachment permit prior to and for all work within road right-of-way. <br /> 3. Maintenance Standard. The minimum improvement standard(s)shall be as <br /> otherwise set forth per the current San Joaquin County Improvement Standards. <br /> 1 <br />
