Hazelton Avenue <br /> Stockton, California 95205 <br /> Attention: Public Services Division <br /> ROAD AND PIPELINE MAINTENANCE AGREEMENT <br /> This Road Maintenance Agreement(the"Obligation") is signed this Al day <br /> of I Pr l , 2015 by Gogna Family Limited Partnership(hereinafter referred to as <br /> "Obligors"). <br /> WHEREAS,the Obligors are owners of APN 119-050-30 (hereinafter referred to as "the <br /> Land") and have made an application for an encroachment permit with the San Joaquin County <br /> Department of Public Works (hereinafter referred to as "County") for the installation of a <br /> private pipeline under a section of County owned road known as Fanning Rd(hereinafter <br /> referred to as "Road", as defined below); and, <br /> WHEREAS,this Obligation for repair and maintenance is a required condition for the <br /> approval of Encroachment Permit No. PS-1500935 with San Joaquin County for the installation <br /> of a private ten inch irrigation pipeline (hereinafter referred to as "Pipeline"). <br /> Now,therefore, in consideration of the above,the Obligor hereto agrees as follows: <br /> 1. Description and Definition of"Road" and"Pipeline." Road is the section of road <br /> situated between APN 119-050-30 and APN 119-050-27 starting at the intersection of the <br /> Pipeline and the north side road right-of-way and continuing southerly parallel to the alignment <br /> of the Pipeline for a distance of seven and a half feet to each side of the pipeline measured <br /> perpendicularly 1fri-.0M th.- v.ciriterllnav o f the panrvluine uluilgnuueut(nu totaaof ftaan TPPtI pir.e�ina io <br /> vi iaivvu ivv�J. i ani uuv au <br /> a private 10"pipeline. Both the Road and Pipeline are shown on the attached Exhibit"A" and <br /> incorporated herein by this reference. <br /> 2. Obligation. This Obligation for repair and maintenance is a required condition for <br /> the approval of Encroachment Permit No. PS-1500935 with San Joaquin County for the <br /> installation of the Pipeline and as consideration for such, Obligors shall be responsible for the <br /> maintenance of Pipeline and Road, including but not limited to the grading and resurfacing of the <br /> Road resulting from installation of Pipeline and/or related to the maintenance of Pipeline. <br /> Obligor shall obtain an encroachment permit prior to and for all work within road right-of-way. <br /> 3. Maintenance Standard. The minimum improvement standard(s) shall be as <br /> otherwise set forth per the current San Joaquin County Improvement Standards. <br /> 1 <br />
