BEFORE THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN JOAQUIN <br /> STATE OF CALIFORNIA <br /> RESOLUTION <br /> R-09- 469 <br /> RESOLUTION APPROVING TEMPORARY CLOSURE OF CLINTON SOUTH AVENUE AND <br /> MELLO AVENUE FOR THE SECOND ANNUAL COLOR THE SKIES HOT AIR BALLOON <br /> FESTIVAURUN.SHINE.GIVE.RUN. EVENT <br /> WHEREAS, Color The Skies, Inc., hereinafter referred to as APPLICANT, has applied for <br /> permission to temporarily close County portions of Clinton South Avenue, between Jack Tone <br /> Road and North Ripon Road, and Mello Avenue, between North Ripon Road and Murphy Road, <br /> for the Second Annual Color The Skies Hot Air Balloon Festival/Rise.Shine.Give.Run. event on <br /> Saturday, September 5, 2009 from 7:30 a.m. to 9:30 a.m. <br /> WHEREAS, this is an annual event, it is anticipated that the APPLICANT will be <br /> requesting permission to temporarily close to traffic County portions of Clinton South Avenue, <br /> between Jack Tone Road and North Ripon Road, and Mello Avenue, between North Ripon <br /> Road and Murphy Road, for the Annual Color The Skies Hot Air Balloon <br /> Festival/Rise.Shine.Give.Run. on the Saturday during Labor Day Weekend in future years. <br /> NOW THEREFORE, BE IT RESOLVED that it is the finding of this Board of Supervisors <br /> that, as authorized by Section 10-2700 of the Ordinance Code of San Joaquin County, it is <br /> necessary for the protection of the public to grant permission to temporarily close portions of <br /> Clinton South Avenue, between Jack Tone Road and North Ripon Road, and Mello Avenue, <br /> between North Ripon Road and Murphy Road, for the Second Annual Color The Skies Hot Air <br /> Balloon Festival/Rise.Shine.Give.Run. event on Saturday, September 5, 2009 from 7:30 a.m. to <br /> 9:30 a.m., and on the Saturday during Labor Day Weekend in future years. <br /> BE IT FURTHER RESOLVED that this action shall be subject to the following conditions: <br /> 1. That an Encroachment Permit shall be obtained from the Department of <br /> Public Works for the temporary road closure. <br /> 2. That the performance of any procedures related to this Permit shall constitute an <br /> acceptance of all the provisions contained herein, and failure on APPLICANT'S <br /> part to comply with any provision will be cause for revocation of this Permit. <br /> 3. The APPLICANT shall provide a general advisory of the road closures for central <br /> distribution to local residents and emergency agencies two weeks prior to the <br /> event. <br />
