Lightwave will offer the Cervices to its <br /> subscribers using facilities whicb it will construct and operate <br /> predominantly for the provision of interstate telecommunications <br /> services . As a nondominant carrier wader the Federal Communica-:ion <br /> Commaasion' s (FCC) regulatory framework, applicant has the <br /> authority to provide noa•awitched transmission services between <br /> IECar POPS, and from end users to FOAs for the purpose of <br /> facilitating ISCs ' interstate interLATA service offerings . <br /> Pursuarit to 47 V.S.C.A. § 214, the FCC does not require <br /> certification for provision of such services by nondominant <br /> carriers . The instant application seeks Comrnisv ion authorization <br /> \ to utilize theme interstate facilities for the provision of <br /> • interLATA a-nd ittraLATA services . <br /> Lightwave will use facilities constructed pursuant to FCC <br /> authority using underground conduits or ducts, utility poles, �.nd <br /> other existing facilities . Therefore, applicant asserts there will <br /> be no significant impact on the environment . Any necessary health <br /> and safety permits or municipal franchises as required for the <br /> construction and operation of Lightwave' s initial service areae <br /> have been or will be obtained from the appropriate city or cowity <br /> offices. Applicant 's use of existing city rights of way -or <br /> existing utility conduits or ducts shows a reasonable certainty <br /> that the proposed construction will have no significant <br /> environmental impacts . <br /> A1tbough Lightwaves initial private line systems will be <br /> constructed, and will provide service, in Alameda and Contra• Costa <br /> counties, applicant seeks statewide authority from the Commission. <br />
