1 subdivision or development of land on the hereinafter described property with certain <br /> 2 conditions of approval which require an Irrevocable Offer to Dedicate a five-foot wide strip <br /> 3 on Calaveras Avenue. <br /> 4 NOW, THEREFORE, for and in consideration of the approval of Site Approval <br /> 5 Application No. PA-0800168, it is agreed by and between the parties hereto as follows: <br /> 6 1. OWNER represents and warrants that it is the fee title OWNER of the land <br /> 7 described in Exhibit "A", which is attached hereto and incorporated herein. <br /> 8 2. OWNER agrees to convey to COUNTY fee title interest free and clear of all taxes, <br /> 9 liens, encumbrances and assessments within ninety (90) days after written.request <br /> 10 for the same is made by COUNTY of the land described in Exhibit "B", which is <br /> 11 attached hereto and incorporated herein. Said land is to be used as a public <br /> 12 roadway. _ <br /> 13 3. This AGREEMENT, consisting of the burdens of conveying the above said road to <br /> 14 COUNTY, is intended to run with the land described in Exhibit "A" attached hereto <br /> 15 and made a part hereof and is binding on the heirs, successors and assigns of the <br /> 16 OWNER and the benefit is to run to the successors and assigns of COUNTY. <br /> 17 <br /> 18 <br /> 19 <br /> 20 <br /> 21 <br /> 22 <br /> 23 <br /> 24 <br /> -2- <br />
