1 conditions of approval which require an Irrevocable Offer to Dedicate land required to allow <br /> 2 the future improvements of Eleventh Street and Chrisman Road as specified in Special <br /> 3 Purpose Plan Report No. 25-6450-18 dated July 2005 per Special Purpose Plan <br /> 4 Application No. PA-0300308. <br /> 5 NOW, THEREFORE, for and in consideration of the approval of Site Approval <br /> 6 Application No. PA-1000250, it is agreed by and between the parties hereto as follows: <br /> 7 1. OWNERS represent and warrant that they are the fee title OWNERS of the land <br /> 8 described in Exhibit "A", which is attached hereto and incorporated herein. <br /> 9 2. OWNERS agree to convey to COUNTY fee title interest free and clear of all taxes, <br /> 10 liens, encumbrances and assessments within ninety (90) days after written request <br /> 11 for the same is made by COUNTY of the land described in Exhibit "B", which is <br /> 12 attached hereto and incorporated herein. <br /> 13 3. This AGREEMENT, consisting of the burdens of conveying the above said road to <br /> 14 COUNTY, is intended to run with the land described in Exhibit "A" attached hereto <br /> 15 and made a part hereof and is binding on the heirs, successors and assigns of the <br /> 16 OWNERS and the benefit is to run to the successors and assigns of COUNTY. <br /> 17 <br /> 18 <br /> 19 <br /> 20 <br /> 21 <br /> 22 <br /> 23 <br /> 24 <br /> -2- <br />
