94073796 <br /> 1 subdivision or development of land on the hereinafter described <br /> 2 property with certain conditions of approval which require an <br /> 3 Irrevocable Offer to Dedicate a 25 foot wide strip on the <br /> 4 west property line of the parcel described in Exhibit "A" . <br /> 5 NOW, THEREFORE, for and in consideration of the approval of <br /> 6 Site Approval SA-94-20, it is agreed by and between the parties hereto <br /> 7 as follows : <br /> 8 1 . OWNERS represent and warrant that they are the fee title OWNERS <br /> 9 of the land described in Exhibit "A" , which is attached hereto <br /> 10 and incorporated herein. <br /> 11 2 . OWNERS agree to convey to COUNTY fee title interest free and <br /> 12 clear of all taxes, liens, encumbrances and assessments within <br /> 13 ninety (90) days after written request for the same is made by <br /> 14 COUNTY of the land described in Exhibit "B" , which is attached <br /> 15 hereto and incorporated herein. Said land is to be used as a <br /> 16 public roadway. <br /> 17 3 . This AGREEMENT, consisting of the burdens of conveying the above <br /> 18 said road to COUNTY, is intended to run with the land described <br /> 19 in Exhibit "A" attached hereto and made a part hereof and is <br /> 20 binding on the heirs, successors and assigns of the OWNERS and <br /> 21 the benefit is to run to the successors and assigns of COUNTY. <br /> 22 <br /> 23 <br /> 24 <br /> 25 <br /> 26 <br /> -2- <br />
