04 56737 <br /> 1 Joaquin County Development Services Division on September i9 , 1991 , <br /> 2 for the subdivision or development of land on the hereinafter <br /> 3 described property with certain conditions of approval which <br /> 4 require an Irrevocable Offer to Dedicate a 50-foot wide strip <br /> 5 along the northerly property line of Parcel 1 and the easterly <br /> 6 and northerly property line of Parcel 5. <br /> 7 NOW, THEREFORE , for and in consideration of the approval of <br /> 8 Minor Subdivision MS-92-2 , it is agreed by and between the <br /> 9 hereto as follows : <br /> 10 1 . OWNERS represent and warrant that they are the fee title <br /> 11 OWNERS of the land described in Exhibit "A" which is attached <br /> 12 hereto and incorporated 'herein. <br /> 13 2. OWNERS agree to convey to COUNTY fee title interest free and <br /> 14 clear of all taxes , liens , encumbrances and assessments <br /> 15 within ninety ( 90 ) days after written request for the same <br /> 16 is made by COUNTY of the land described in Exhibit "B" which <br /> 17 is attached hereto and incorporated herein. Saia land is to <br /> 18 be used as a public roaaway. <br /> 19 3 . This Agreement, consisting of the burdens of conveying the <br /> 20 above said road to COUNTY, is intended to run with the land <br /> 21 described in Exhibit "A" attached hereto and made a part <br /> 22 hereof and is binding on the heirs, successors and assigns of <br /> 23 the OWNERS and the benefit is to run to the successors and <br /> 24 assigns of COUNTY. <br /> 25 <br /> 26 <br /> 27 <br /> -2- <br />
