1 Joaquin County Community Development Department on May 26, 2005, for the subdivision <br /> 2 or development of land on the hereinafter described property with certain conditions of <br /> 3 approval which require an Irrevocable Offer to Dedicate a 50-foot wide strip with 50-foot <br /> 4 radius cul-de-sac and 20-foot by 20-foot corner cut-off on Loramar Lane (formerly <br /> 5 Adelen Avenue), a private road. <br /> 6 NOW, THEREFORE, for and in consideration of the approval of Site Approval <br /> 7 Application No. PA-05-81, it is agreed by and between the parties hereto as follows: <br /> 8 1. OWNERS represent and warrant that they are the fee title OWNERS of the land <br /> 9 described in Exhibit "A", which is attached hereto and incorporated herein. <br /> 10 2. OWNERS agree to convey to COUNTY fee title interest free and clear of all taxes, <br /> 11 liens, encumbrances and assessments within ninety (90) days after written request <br /> 12 for the same is made by COUNTY of the land described in Exhibit "B", which is <br /> 13 attached hereto and incorporated herein. Said land is to be used as a public <br /> 14 roadway. <br /> 15 3. This AGREEMENT, consisting of the burdens of conveying the above said road to <br /> 16 COUNTY, is intended to run with the land described in Exhibit "A" attached hereto <br /> 17 and made a part hereof and is binding on the heirs, successors and assigns of the <br /> 18 OWNERS and the benefit is to run to the successors and assigns of COUNTY. <br /> 19 <br /> 20 <br /> 21 <br /> 22 <br /> 23 <br /> 24 <br /> -2- <br />
